Alfred Agbesi Woyome <\/strong><\/p>\nAnother attempt by embattled businessman Alfred
\nAgbesi Woyome to stop the state from selling his properties to offset his GH\u00a246
\nmillion debt has hit the snag, as the Supreme Court yesterday dismissed his application
\nfor stay of execution.<\/p>\n
He filed the application pleading with the
\ncourt to put on hold the sale of two of his mansions, claiming that he was
\ndetermined to pay the money if the execution of the court order was stayed.<\/p>\n
His application emanated from the Supreme
\nCourt\u2019s order secured by the state allowing it to go ahead and sell the
\nidentified properties to offset the GH\u00a251.2 million he fraudulently received as
\njudgement debt in 2011.<\/p>\n
In July this year, his lawyers filed the
\napplication to stay the execution of the order, with the promise that they were
\ncommitted to paying GH\u00a210 million and paying GH\u00a24 million every 90 days if the
\nexecution order was suspended.<\/p>\n
Woyome
\nBankrupt<\/strong><\/p>\nMoving the application yesterday, his lawyer,
\nMuda Ade Lawal, pleaded with the court to stay the execution, saying if the properties
\nwere sold Woyome would go bankrupt.<\/p>\n
He said if the execution was stayed, they were
\nwilling to pay GH\u00a210 million immediately and pay GH\u00a24 million every nine
\nmonths.<\/p>\n
He told the court that selling the properties
\nwould put Woyome in a difficult situation, as he depends on the rent he gets
\nfrom the properties that are about to be auctioned by the state.<\/p>\n
\u201cIf the execution of the judgment is levied on
\nus, we are sure to go bankrupt,\u201d the counsel pleaded with the court.<\/p>\n
Dame
\nResponse<\/strong><\/p>\nThe application was, however, opposed by the Deputy
\nAttorney General, Godfred Yeboah Dame, who argued that if Woyome was willing to
\npay the money, he would pay the GH\u00a210 million instead of filing an application
\nfor stay of execution.<\/p>\n
He said this is not the first time Woyome had
\npromised to pay GH\u00a24.5 million every three months but had refused to pay even a
\npenny.<\/p>\n
He said taking into consideration the profit that
\nhad accrued on the debt, it would take Woyome well over four years to finish
\npaying the money based on the payment plan proposal he made in his application.<\/p>\n
Mr. Dame added that the state had laid hands on
\n\u2018certain\u2019 properties of Woyome and was on the verge of selling them off while
\nothers are being identified; he, therefore, asked the court to dismiss the
\napplication.<\/p>\n
Judges\u2019
\nConcern<\/strong><\/p>\nThe panel of judges hearing the matter
\nexpressed concern about the delay in paying the money since the order was given
\nby the court for Woyome to refund the money.<\/p>\n
Justice Paul Baffoe-Bonnie recalled how other
\nlawyers came to the Supreme Court and pledged to have Woyome pay the money in instalment
\nbut the commitment was not met saying \u201call we heard was that you went to a
\ndifferent court.\u201d<\/p>\n
Justice Sule Gbadegbe told the lawyer that if
\nthey want to pay the money in instalment, the way forward was not to challenge
\nthe judgement but rather come before the court to explain that due to certain circumstances
\nthey are unable to pay the money at a go. <\/p>\n
Final
\nRuling <\/strong><\/p>\nThe panel presided over by Justice Baffoe-Bonnie
\nand assisted by Justices Sule Gbadegbe, Alfred Benin, Samuel Marful-Sau and
\nAgnes Dordzie dismissed the application as \u2018unmeritorious\u2019.<\/p>\n
The court said that was not the first time
\nWoyome had made the commitment to pay the money in instalment and the application
\nshowed that it would take him more than four years to pay the entire amount.<\/p>\n
The panel held that it had been more than five
\nyears since the judgement for Woyome to refund the money with interest was
\ndelivered and it would be unfair to further delay the payment. <\/p>\n
New
\nProperty<\/strong><\/p>\nMeanwhile, the Supreme Court has adopted the
\nforced sale value of GH\u00a24.485 million valuation of another mansion belonging to
\nWoyome located at Trasacco Valley in Accra.<\/p>\n
This is the third property which has been valued
\nand is about to be auctioned to the public, bringing the total amount to be
\nrealised from the sale of the mansions to GH\u00a227.885 million.<\/p>\n
