Hits SupremeCourt Again &#8211;"},"content":{"rendered":"<p><\/p>\n<div>\n<p><strong>William Tevie and Eugene Baffoe Bonnie<\/strong><\/p>\n<p>The<br \/>\ncase involving four former board members of National Communications Authority<br \/>\n(NCA) and a businessman has once again been sent to the Supreme Court. <\/p>\n<p>Lawyer<br \/>\nfor Dr. Nana Owusu Ensaw has filed an application for certiorari praying the<br \/>\napex court to quash the decision of the trial judge who ordered his client to open<br \/>\nhis defence.<\/p>\n<p>This<br \/>\nwas after the judge found that the prosecution had been able to establish a<br \/>\nprima facie case against him and the others.<\/p>\n<p>This is<br \/>\nthe third time the case has been sent to the Supreme Court challenging the<br \/>\ndecision of Justice Eric Kyei Baffuor, the presiding judge. <\/p>\n<p><strong>Trial<\/strong><\/p>\n<p>Some former NCA board members \u2014 Eugene Baffoe-Bonnie, William Tetteh-Tevie,<br \/>\nDr. Nana Owusu Ensaw, Alhaji Salifu Mimina Osman and businessman George Dereck<br \/>\nOppong \u2014 are<br \/>\nbefore an Accra High Court charged with causing financial loss to the state,<br \/>\namong other charges, in the purchase of Pegasus equipment.<\/p>\n<p>The<br \/>\naccused persons are facing a total of 17 charges including money laundering. <\/p>\n<p>The<br \/>\nprosecution led by Director of Public Prosecutions (DPP), Yvonne Atakora-<br \/>\nObuobisa, closed its case on April 18, 2019 after calling six witnesses to<br \/>\nprove its case.<\/p>\n<p><strong>Applications<\/strong><\/p>\n<p>The<br \/>\naccused persons opted not to open their defence but rather filed a submission<br \/>\nof no case to answer, saying the prosecution had not proved its case beyond<br \/>\nreasonable doubt to warrant the accused persons opening their defences. <\/p>\n<p>The<br \/>\npresiding judge, in his ruling, dismissed the applications and ordered the<br \/>\naccused persons to open their defence on May 30, 2019.<\/p>\n<p>The<br \/>\nfive then filed numerous appeals challenging the decision of the court to<br \/>\ndismiss their submission of no case.<\/p>\n<p>They<br \/>\nalso filed for a stay of proceeding pending the determination of the appeal but<br \/>\nall the applications were dismissed.<\/p>\n<p>They<br \/>\nthen went to the Court of Appeal seeking an order to stay the trial but those<br \/>\napplications were equally dismissed and they were ordered to return to the<br \/>\ntrial court to open the defence.<\/p>\n<p>Lawyer<br \/>\nfor Baffoe-Bonnie then filed a fresh application praying the court to stay its<br \/>\nproceedings pending an appeal of its ruling saying their earlier application<br \/>\nwas in respect of the admission of his client\u2019s \u2018confession statement\u2019.<\/p>\n<p>The<br \/>\napplication was also dismissed and Justice Kyei Baffour expressly told the<br \/>\nlawyers to stop \u201cprostituting with legal processes\u201d by filing the \u201cnumerous<br \/>\nfrivolous and vexatious\u201d applications.<\/p>\n<p><strong>New Motion<\/strong> <\/p>\n<p>The<br \/>\nlatest application at the Supreme Court is seeking an order for certiorari to<br \/>\nquash the decision of the trial court to call on Dr. Nana Ensaw to open his<br \/>\ndefence on two charges of conspiracy to steal and money laundering. <\/p>\n<p>The<br \/>\nlawyer, Johnson Normesinu, subsequently prayed the court to stay its<br \/>\nproceedings pending the determination of the certiorari application since his<br \/>\nclient was charged for allegedly conspiring with the others to steal. <\/p>\n<p>The<br \/>\nDirector of Public Prosecutions, Yvonne Atakora-Obuobisa, stated that she would<br \/>\nhave preferred the case continued but since the accused person was facing a<br \/>\nconspiracy charge, she would leave the decision to the discretion of the judge.\n<\/p>\n<p>Justice<br \/>\nKyei Baffuor subsequently adjourned the matter to November 12, 2019 pending the<br \/>\ndetermination of the application slated for October 29.<\/p>\n<p><strong>Dizziness<\/strong><\/p>\n<p>Earlier,<br \/>\nMr. Baffoe-Bonnie could not continue with his defence which was slated for<br \/>\ntoday.<\/p>\n<p>The<br \/>\nformer NCA Board Chairman had at the tail end of last legal year opened his<br \/>\ndefence but could not continue as his lawyer prayed the court to give them some<br \/>\ntime \u201cto put their house in order\u201d.<\/p>\n<p>Appearing<br \/>\nbefore the court yesterday, his lawyer, Abu Juan, who prayed for an adjournment<br \/>\nagain, saying Mr. Baffoe-Bonnie was suffering a \u201crunning stomach\u201d and \u201cfeeling<br \/>\ndizzy\u201d as well hence could not stay in the witness box. <\/p>\n<p>He<br \/>\nprayed for an adjournment to enable his client to seek medical attention.<\/p>\n<p>The DPP did not oppose the prayer and the presiding judge granted it. <\/p>\n<p><strong>BY Gibril Abdul
