Hard Drives In Opuni Trial Missing"},"content":{"rendered":"<p><\/p>\n<div>\n<p><strong>Dr. Stephen Opuni<\/strong><\/p>\n<p>The<br \/>\ncomputer hard drive being used in the courtroom to record proceedings in the<br \/>\ntrial of former Chief Executive Officer (CEO) of Ghana Cocoa Board (COCOBOD),<br \/>\nDr. Stephen Opuni, and businessman, Seidu Agongo, has gone missing, <strong><em>DAILY<br \/>\nGUIDE<\/em><\/strong> has gathered.<\/p>\n<p>According<br \/>\nto sources, the hard drive was taken away during the legal vacation of the<br \/>\nJudicial Service when the courts were not sitting.<\/p>\n<p>It<br \/>\nis unclear who carried out the act and the motive behind the stealing of the<br \/>\nhard drive which contains everything that has transpired in the trial which<br \/>\nstarted in March last year.<\/p>\n<p>It is also not known yet if there is a backup of the<br \/>\nproceedings on any external hard drives or if the proceedings were captured on<br \/>\nthe Electronic Justice System \u2014<br \/>\nthe e-Justice system introduced by the Judicial Service.<\/p>\n<p>Apart from the hard drive of the computer in<br \/>\n\u2018Criminal Court 1\u2019 where Dr. Opuni\u2019s trial is taking place, hard drives in some<br \/>\nthree other courts \u2014<br \/>\nall<br \/>\nlands courts \u2014<br \/>\nwere also reportedly stolen.<\/p>\n<p><strong>Serious Problem<\/strong><\/p>\n<p>When the case \u2014 which was put on hold for two months as<br \/>\na result of \u00a0the legal vacation \u2014<br \/>\nwas called yesterday, the Presiding Judge, Justice Clemence Honyenuga, informed<br \/>\nthe prosecution and the defence lawyers that there was a \u201ctechnical problem, a<br \/>\nserious technical problem as such, for which reason the computer screens cannot<br \/>\ndisplay.\u201d<\/p>\n<p>But<br \/>\n<strong><em>DAILY<br \/>\nGUIDE<\/em><\/strong> after the court proceedings gathered that the \u201cserious technical<br \/>\nproblem\u201d the judge was referring to could be the missing hard drives.<\/p>\n<p><strong>Arrests<\/strong><\/p>\n<p>Unconfirmed<br \/>\nreports state that some staff members of the Judicial Service have been picked<br \/>\nup by operatives of the National Security in connection with the missing hard<br \/>\ndrives.<\/p>\n<p>According<br \/>\nto sources, among the persons arrested for interrogation include persons who<br \/>\nwork in the affected courts, as well as some staff from the Information<br \/>\nTechnology (IT) department of the Judicial Service.<\/p>\n<p>Information<br \/>\navailable indicates that the arrested staff members were questioned and their<br \/>\nmobile phones have been seized for further investigations.<\/p>\n<p><strong>Repeat Application<\/strong><\/p>\n<p>Meanwhile,<br \/>\nthe trial of Dr. Opuni and businessman Seidu Agongo has been adjourned to<br \/>\nNovember 13, 2019.<\/p>\n<p>This<br \/>\nfollows application for stay of proceedings filed by Samuel Cudjoe, lawyer for Dr.<br \/>\nOpuni, at the Court of Appeal.<\/p>\n<p>The<br \/>\napplication emanated from the ruling of the judge who rejected attempts by Dr.<br \/>\nOpuni\u2019s lawyer to tender a letter signed by one Dr. Opoku-Ameyaw through the<br \/>\nstate\u2019s witnesses.<\/p>\n<p>That<br \/>\nwas the second time this year that the accused has filed applications at the<br \/>\nHigh Court hearing the case and another at the Court of Appeal seeking to stay<br \/>\nthe proceedings.<\/p>\n<p>According<br \/>\nto Justice Honyenuga of the Court of Appeal, sitting as an additional High<br \/>\nCourt judge, staying of proceedings would further delay the trial, as the third<br \/>\nprosecution witness has been in the box for months.<\/p>\n<p>It<br \/>\nwas the ruling of the trial judge that Dr. Opuni\u2019s lawyer could not provide a<br \/>\nsingle reason for which the application for stay of proceedings should be granted.<\/p>\n<p>Not<br \/>\nsatisfied with the decision, the lawyer has filed another application for stay of<br \/>\nproceedings at the Court of Appeal pending the determination of an appeal<br \/>\nagainst the decision.<\/p>\n<p>It<br \/>\nwould be recalled that a similar application was dismissed by the Court of<br \/>\nAppeal because it failed to raise any exceptional circumstance for the trial to<br \/>\nbe stayed.<\/p>\n<p><strong>Trial<\/strong><\/p>\n<p>Dr.<br \/>\nOpuni and Seidu Agongo, Managing Director of Agricult Ghana Limited, are before<br \/>\nan Accra High Court for causing financial loss to the state to the tune of GH\u00a2217,370,289.22.<\/p>\n<p>The<br \/>\ntwo are facing a total of 27 charges, including defrauding by false pretence,<br \/>\nwillfully causing financial loss to the state, money laundering, corruption by<br \/>\na public officer and contravention of the Public Procurement Act.<\/p>\n<p>The<br \/>\ntwo are in court over the purchase and supply of Lithovit fertilizer which the<br \/>\nstate said was done in contravention of several laws.<\/p>\n<p>The prosecution led by Director of Public Prosecutions, Yvonne Atakora-Obuobisa, has called three witnesses so far and the third witness, a former Deputy CEO of COCOBOD, Dr. Yaw Adu-Ampomah,\u00a0who entered the witness box
