{"id":715060,"date":"2019-10-02T18:04:46","date_gmt":"2019-10-02T18:04:46","guid":{"rendered":"https:\/\/ghana-mma.com\/2019\/10\/02\/blow-whistle-on-wrongdoers\/"},"modified":"2019-10-02T18:04:46","modified_gmt":"2019-10-02T18:04:46","slug":"blow-whistle-on-wrongdoers","status":"publish","type":"post","link":"https:\/\/www.ghanamma.com\/2019\/10\/02\/blow-whistle-on-wrongdoers\/","title":{"rendered":"Blow Whistle On Wrongdoers &#8211;"},"content":{"rendered":"<p><\/p>\n<div>\n<p><strong>Charles Ayamdoo<\/strong><\/p>\n<p>The Commission on Human Rights and Administrative<br \/>\nJustice (CHRAJ) has challenged Ghanaians to report wrongdoers to the commission<br \/>\nto cut down on corruption.<\/p>\n<p>The commission has, therefore, assured total<br \/>\nprotection for people who come forward to report crimes.<\/p>\n<p>Chief Director of the commission, Charles Ayamdoo,<br \/>\nwho made the call, noted that CHRAJ is an independent body that cannot be<br \/>\npolitically influenced in the performance its works, adding that by reporting<br \/>\nwrongdoers, whistleblowers help to save billions of public funds.<\/p>\n<p>He was speaking at a one-day stakeholders\u2019<br \/>\nsensitization workshop organised by the Office of the Attorney General and<br \/>\nMinister of Justice on the Whistleblower Act and Procurement Standard Clause.<\/p>\n<p>The programme drew participants from government<br \/>\nagencies such as Ghana Standards Authority, Ghana Revenue Authority, Public<br \/>\nProcurement Authority as well civil society organisation and the press.<\/p>\n<p>The Whistleblower Act, 2006 (Act 720) makes provisions<br \/>\nfor the manner in which individuals in the public interest disclose information<br \/>\nthat relates to unlawful or other illegal conduct or corrupt practices of<br \/>\nothers.<\/p>\n<p>The Act provides for the protection of<br \/>\nwhistleblowers against victimization and also provides for a fund to reward<br \/>\nindividuals who make the disclosure.<\/p>\n<p>Explaining the imports of the Act, Mr. Ayamdoo<br \/>\nindicated that the Act empowers individuals to make disclosure of information<br \/>\nwhen they have reasonable cause to believe that the information tend to show an<br \/>\neconomic crime \u201chas been committed, is about to be committed or likely to be<br \/>\ncommitted.\u201d<\/p>\n<p>He said disclosures can also be made when<br \/>\n\u201canother person has not complied with a law or is in the process of breaking a<br \/>\nlaw or is likely to break a law that imposes an obligation on that person,\u201d as<br \/>\nwell as\u00a0 if a \u201cmiscarriage of justice has<br \/>\noccurred, is occurring or is likely to occur.\u201d<\/p>\n<p>He expressed dissatisfaction about the number of<br \/>\ndisclosures the commission received, saying the commission had since the<br \/>\npassage of Act in 2006 received less than 50 disclosures \u2013 and only four in<br \/>\n2019.<\/p>\n<p>A chief state attorney, Asiama Sampong who took<br \/>\nparticipants through the role of the AG in implementing the Act touched on<br \/>\nreward schemes for whistleblowers which include 10 per cent of all public funds<br \/>\nrecovered.<\/p>\n<p>He said disclosures could be made to 18 different<br \/>\npersons and individuals including the employer of the whistleblower, a police<br \/>\nofficer, the AG, the Auditor General, an MP, the Narcotic Control Board, EOCO,<br \/>\namong others.<\/p>\n<p>He added that whistleblowers were not liable to<br \/>\ncivil and criminal action unless he or she knew the information disclosed was<br \/>\nmalicious, adding that investigators of disclosures who conceal or suppress<br \/>\nevidence are liable for up to five years jail term.<\/p>\n<p>Abdul Latif Alhassan, an official of PPA also<br \/>\ntook participants through the Procurement Standard Clause and indicated that<br \/>\nthe PPA had instituted a Zero Tolerance Against Corruption And Fraud campaign<br \/>\nand crimes could be reported via toll free number 080010070.<\/p>\n<p><strong>BY Gibril Abdul Razak<\/strong><\/p>\n<\/p><\/div>\n","protected":false},"excerpt":{"rendered":"<p>Charles Ayamdoo The Commission on Human Rights and Administrative Justice (CHRAJ) has challenged Ghanaians to report wrongdoers to the commission to cut down on corruption.
