Bank Siphoned $62m- BoG"},"content":{"rendered":"<p><\/p>\n<div>\n<p><strong>Dr. Papa Kwesi Nduom<\/strong><\/p>\n<p>The<br \/>\nclean-up of the banking, specialized deposit-taking (SDT) and non-bank<br \/>\nfinancial institutions (NBFI) sectors in the country by the Bank of Ghana (BoG)<br \/>\nis\u00a0 opening the Pandora\u2019s box with regard<br \/>\nto how some of the owners illegally transferred customers\u2019 savings and<br \/>\ninvestments without traces.<\/p>\n<p>The<br \/>\nCentral Bank last Friday struck once again when it announced a revocation of<br \/>\nthe licenses of some 23 insolvent savings and loans and finance house companies<br \/>\nincluding GN Savings and Loans Ltd which is one of the many companies belonging<br \/>\nto businessman, entrepreneur and politician, Dr. Papa Kwesi Nduom.<\/p>\n<p><strong>Massive Transfers<\/strong><\/p>\n<p>According<br \/>\nto the Central Bank\u2019s report, GN Savings and Loans transferred $62 million and<br \/>\nanother 718,000 Pounds Sterling to its sister company in the US without the<br \/>\nknowledge of BoG and the Ministry of Finance.<\/p>\n<p>The<br \/>\nCentral Bank said GN Bank was in breach of section 19 of the Foreign Exchange<br \/>\nAct 2006, Act 723, Section IV of Bank of Ghana Notice No. BG\/GOV\/SEC\/2007\/4,<br \/>\nand subsequent Bank of Ghana notices issued in August 2014 prohibiting such<br \/>\npractices.<\/p>\n<p>The<br \/>\nBoG, in its release last week, announcing the closures of the said financial<br \/>\ninstitutions, indicated that the financial condition of the GN Savings and Loans<br \/>\nLimited has deteriorated since its reclassification from GN Bank in 2018, with<br \/>\nboth negative capital adequacy ratio and negative net worth.<\/p>\n<p>It<br \/>\nadded that GN Savings and Loans Capital Adequacy Ratio (CAR) was -61% in breach<br \/>\nof the minimum required of 13%. <\/p>\n<p><strong>Severe Liquidity<\/strong><\/p>\n<p>The<br \/>\nBoG revealed that GN Savings and Loans was also facing a severe liquidity<br \/>\ncrisis with numerous complaints received by the Financial Stability Department<br \/>\nof the BoG from aggrieved customers who have been unable to access their deposits<br \/>\nwith the institution for the past several months. <\/p>\n<p>\u201cWhat<br \/>\nis more, it has consistently failed to meet the minimum cash reserve<br \/>\nrequirement of 10% of its total deposits, since the end of the first quarter of<br \/>\n2019,\u201d it said.<\/p>\n<p><strong>Debt and Illegal Transfer<\/strong><\/p>\n<p>According<br \/>\nto the Central Bank, while GN has indicated that government owes it a total<br \/>\namount of GH\u00a2942.98 million of which GH\u00a2102.73 million represented Interim<br \/>\nPayment Certificates (IPCs), the BoG\u2019s assessment is that IPCs totalling<br \/>\nGH\u00a230.33 million only have been confirmed by the Ministry of Finance as of 6th<br \/>\nAugust 2019 as owed to contractors that may be indebted to affiliates of GN.<\/p>\n<p>The<br \/>\nBoG\u2019s supervisory assessment shows that even when the total outstanding IPCs<br \/>\namount of GH\u00a230.33 million was considered, it still did not address GN\u2019s<br \/>\ncapital deficit of -GH\u00a2683.66 million, the Central Bank said.<\/p>\n<p>\u201cIt<br \/>\nmust be noted that GN\u2019s insolvency problems are largely attributable to<br \/>\noverdraft and other facilities it extended to its related parties who are other<br \/>\ncompanies in the Groupe Nduom network of businesses under circumstances that<br \/>\nviolated relevant prudential norms,\u201d the BoG report said.<\/p>\n<p>It<br \/>\nsaid of particular interest are the funds totalling GH\u00a2761.55 million that GN<br \/>\nBank, as it then was, placed with its sister companies \u2013 Ghana Growth Fund<br \/>\n(Gold Coast Advisors) and Gold Coast Fund Management Limited (now Blackshield<br \/>\nCapital Management) \u2013 both licensed by the Securities and Exchange Commission. <\/p>\n<p>According<br \/>\nto BoG, some of these funds were used by the two related parties to pay their<br \/>\ncustomers whose investments with them had matured, while some were also used to<br \/>\nfund road and other contractors, who claim to have worked on government<br \/>\nprojects.<\/p>\n<p><strong>Violation of Prudential Norms<\/strong><\/p>\n<p>The<br \/>\nBoG cited violation prudential norm by GN Savings and Loans, saying \u201cthey<br \/>\nreflect transactions entered into by Ghana Growth Fund or Gold Coast Fund<br \/>\nManagement with these contractors using funds taken from GN under circumstances<br \/>\nthat violated prudential norms. The failure of the two related parties to pay<br \/>\nback these funds to GN affected GN\u2019s capital position, leading eventually to<br \/>\nits insolvency and acute liquidity challenges.\u201d<\/p>\n<p><strong>Nduom\u2019s Facebook Rebuttal<\/strong><\/p>\n<p>Dr.<br \/>\nNduom has since rebutted the claims and described the BoG\u2019s statement as<br \/>\n\u201ceither gross negligence on the part of the BoG, or an egregious<br \/>\nmisrepresentation of the truth designed to drag our name in the mud.\u201d<\/p>\n<p>He<br \/>\nsaid in his Facebook post that \u201cthe information about International Business<br \/>\nSolutions is false. International Business Solutions has two main business<br \/>\nlines \u2013 Management Consulting and Import\/Export. All of the funds mentioned are<br \/>\ncomprised of payments of invoices for goods and services that were rendered in<br \/>\nGhana.<\/p>\n<p>\u201cTo<br \/>\nuse it as justification for any regulatory action is either gross negligence on<br \/>\nthe part of the BoG, or an egregious misrepresentation of the truth designed to<br \/>\ndrag our name in the mud.<\/p>\n<p>\u201cThe<br \/>\nBoG has all the documents for every pesewa transferred out of Ghana and there<br \/>\nwas absolutely nothing wrong with engaging in an international business. The<br \/>\nreal scandal is the GHS 2.2 Billion Cedi portfolio that the Ministry of Finance<br \/>\nhas held hostage for over two years.<\/p>\n<p>\u201cTheir<br \/>\nrefusal to acknowledge and pay these debts is what they are using to destroy a<br \/>\nstrong Ghanaian company,\u201d he said.<\/p>\n<p><strong>More Companies<\/strong><\/p>\n<p>Apart<br \/>\nfrom Dr. Nduom\u2019s GN Savings and Loans Ltd., prominent companies like Ideal<br \/>\nFinance Ltd., IFS Financial Services Ltd., Legacy Capital Savings and Loans<br \/>\nLtd., Midland Savings and Loans Company Ltd., Sterling Financial Services Ltd.,<br \/>\nuniCredit Savings and Loans Ltd., Women\u2019s World Banking Savings and Loans Co.<br \/>\nLtd., Accent Financial Services Ltd. and Adom Savings and Loans Ltd have their<br \/>\nlinces revoked.<\/p>\n<p>Others<br \/>\nare All Time Finance Ltd., Alpha Capital Savings and Loans Ltd., ASN Financial<br \/>\nServices Ltd., CDH Savings and Loans Ltd., Commerz Savings and Loans Ltd.,<br \/>\nCrest Finance House Ltd., Dream Finance Company Ltd., Express Savings and Loans<br \/>\nCompany Ltd., the First African Savings and Loans Company Ltd., First Allied<br \/>\nSavings and Loans Co. Ltd., First Ghana Savings and Loans Co. Ltd., First Trust<br \/>\nSavings and Loans Ltd. and Global Access Savings and Loans Company Ltd. <\/p>\n<p>The<br \/>\nBoG has said the actions were taken pursuant to Section 123 (1) of the Banks<br \/>\nand Specialised Deposit-Taking Institutions Act, 2016 (Act 930) and<br \/>\nsubsequently appointed Eric Nipah as a Receiver for the specified institutions<br \/>\nin line with section 123 (2) of Act 930. <\/p>\n<p><strong>Payments Assured<\/strong><\/p>\n<p>In<br \/>\nline with the government\u2019s commitment to protect depositors\u2019 funds, BoG said<br \/>\ngovernment had made funds available to enable the Receiver pay depositors after<br \/>\ntheir claims are validated. <\/p>\n<p>\u201cThe<br \/>\nReceiver will in due course make an announcement with regard to when and where<br \/>\npayments will be made.
