{"id":611824,"date":"2019-04-30T18:48:11","date_gmt":"2019-04-30T18:48:11","guid":{"rendered":"<br><div>\n<p class=\"floatLeft\">General News of Tuesday, 30 April 2019<\/p>\n<p class=\"floatRight\"><strong>Source: <\/strong>Myjoyonline.com <\/p>\n2019-04-30\n\n<div class=\"article-left\">\n<p class=\"article-image\"><img src=\"https:\/\/cdn.ghana-mma.com\/2019\/04\/26429"},"modified":"2019-04-30T18:48:11","modified_gmt":"2019-04-30T18:48:11","slug":"president-yet-to-receive-rti-law-one-month-after-passage","status":"publish","type":"post","link":"https:\/\/www.ghanamma.com\/2019\/04\/30\/president-yet-to-receive-rti-law-one-month-after-passage\/","title":{"rendered":"President yet to receive RTI law one month after passage"},"content":{"rendered":"<p><\/p>\n<div>\n<p class=\"floatLeft\">General News of Tuesday, 30 April 2019<\/p>\n<p class=\"floatRight\"><strong>Source: <\/strong>Myjoyonline.com <\/p>\n<p>2019-04-30<\/p>\n<div class=\"article-left\">\n<p class=\"article-image\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/cdn.ghanamma.com\/2019\/04\/26429549.295.jpg\" alt=\"Bagbin Kyei Mensah7\" title=\"Bagbin Kyei Mensah7\" width=\"295\" height=\"172\" \/><span class=\"image_caption\"><span>Majority Leader, Osei Kyei Mensah-Bonsu and Second Deputy Speaker of Parliament, Alban S.K Bagbin<\/span><\/span><\/p>\n<\/div>\n<p style=\"clear:right\">President Akufo-Addo is yet to assent to the Right to Information Law one month after its passage late into the night.<\/p>\n<p>Parliament has not forwarded the law to the President, Majority Leader and Minister for Parliamentary Affairs, Osei Kyei Mensah-Bonsu, told JoyNews Tuesday.<\/p>\n<p>He has explained, officers of Parliament are taking the law through a \u201cfine comb,\u201d a practice he noted is routine for all bill passed by Parliament.<\/p>\n<p>\u201cA misplacement of even a punctuation mark could alter the character of a whole provision.\u201d<\/p>\n<p>Tech\u00adni\u00adcally, the Pres\u00adi\u00addent needs to ap\u00adpend his sig\u00adna\u00adture for a bill to be\u00adcome law.<\/p>\n<p>The law is meant to operationalise Article 21 (1) (f) of the Constitution which states that \u201cAll persons shall have the right to information subject to such qualifications and laws as are necessary in a democratic society.\u201d<\/p>\n<p>The passage of the 19-year old RTI bill required sustained pressure from the media and civil society groups, prominently, the RTI coalition.<\/p>\n<p>Dogged down by delays and postponements, it was finally passed March 26, 2019, with a caveat that delays its implementation to 2020.<\/p>\n<p>It was explained, despite its passage, there is no budgetary allocation to fund its implementation, an argument the RTI Coalition has found bizarre.<\/p>\n<p>A member of the coalition, Samson Lardy Anyenini, has said several bills have been passed and implemented without budgetary allocations.<\/p>\n<p>But the latest delay in obtaining presidential assent is not uncharacteristic of Parliament, the Suame MP and Majority Leader indicated.<\/p>\n<p>He said, three other bills are going through the clean-up. Nonetheless, he called the failure to forward the law to the president a \u201cself-indictment\u201d on Parliament.<\/p>\n<p>Osei-Kyei Mensah-Bonsu said Parliament does not delay in forwarding to the president, laws such as the Appropriation Bill which allocate and approves the government\u2019s budget.<\/p>\n<p>By law, the Appropriation Bill must be passed and assented to, before the expiration of the financial year, he said.<\/p>\n<p>Usually, it does not take more than seven days for the president to assent to the Appropriation Bill after it is passed.<\/p>\n<p>\u201cThose ones we rush to clean up so we should apply the same diligence to all the bills,\u201d the Suame MP said.<\/p>\n<p>The Majority Leader noted the silence of the 1992 constitution on the acceptable time period within which the law should be sent to the President, is also part of the problem.<\/p>\n<p>\u201cTo me, it is a tragedy.
