The applicants, Glorie Osafo Agyemang-Duah and Osei Agyemang-Duah petitioned the Commercial Division of Kumasi High Court that Watch & Dine Cinema and five others should be cited for contempt.
The explanation given was that Watch & Dine Cinema and five others have brought the administration of justice into disrepute by deliberate conduct of disregarding an order of interim injunction imposed on them by the court on May 7, 2019.
Until the judgment by His Lordship Justice Dr. Richmond Osei-Hwere, earlier reports had accused George Odiase and five others for contravening an order by the Kumasi High Court.
However, the court on Tuesday, July 16, 2019, ruled that the applicants, Glorie Osafo Agyeman-Dish and Osei Agyeman-Duah failed to provide enough evidence to substantiate their case of contempt.
The concluding parts of the ruling read” In conclusion, the applicants are not entitled to the order sought, as they have failed to prove that the Respondents willfully disobeyed the injunction order of the court dated 7th May 2019 and that they (Respondents) have acted in a way that brings the court into disrepute. Consequently, I dismiss the application.”
On the issue of cost, the Commercial Division of Kumasi High Court ordered that an amount of GHC 8,000.00 be paid by the applicants to the plaintiffs.
