Fly TV Directors cited for Contempt over unauthorized Premier League broadcast

The Directors of Nour Vision Ltd, operators of Fly TV in Ghana have been cited for contempt of court for the unauthorized airing of football matches of the Premier League in disregard of a pending injunction application.

Multichoice and SuperSport initiated a case against Fly TV at the Commercial Court, Accra in relation to the unauthorized broadcasts of the FIFA World Cup 2018, the PL and other television content rights violations.

On 20th of June 2018, the High Court granted an injunction order against Nour Vision Ltd, operators of Fly TV restraining them from further airing of the football matches and the station subsequently stopped the broadcasts in compliance with the court order.

On 22 June 2018 Lawyers for SuperSport filed an application for interlocutory injunction to restrain Fly TV from broadcasting the football matches of the PL.

On 3rd July 2018 when the application was due to be heard by the court, Lawyers for Nour Vision Ltd pleaded with the court for more time to enable them to file an affidavit in opposition but subsequently adopted all kinds of delay tactics to delay the hearing of the application for injunction until the legal vacation began on 1st August 2018.

With the start of the PL on 10 August, Fly TV began airing the PL football matches despite the pending injunction application which had not been moved because of their repeated pleas for adjournments. The two directors of the company namely Rabih Fahs and El Akhrass Akoghe have therefore been cited for contempt of court before a vacation court in Accra. The application which is seeking the imprisonment of the two directors is to be heard on 28 August 2018.

According to Cecil Sunkwa Mills, General Manager, MultiChoice Ghana, “we will continue to collaborate with the necessary authorities to protect our content from illegal broadcasting/re-broadcasting”.
