Major Mahama PathologistThe autopsy report of the late Major Maxwell Mahama has ben submitted to the court

Dr Lawrence Edusei, the pathologist who worked on the body of Major Maxwell Adam Mahama, has submitted the full autopsy report on the military officer to the Accra Central District Court.

The submission of the report followed an order by the court directing the pathologist to release the report within three weeks.

That was after police prosecutors had told the court that the pathologist had refused to release the report and all attempts to access it had proved futile.

According to the police, they needed the report to facilitate the committal proceedings of the 22 people accused of killing Major Mahama at Denkyira Obuasi.

Doctor’s claims

On October 26, 2017, Dr Lawrence Edusei appeared before the court, presided over by Mr Ebenezer Kweku Ansah, to explain why the report was not ready.

The medical officer rejected claims by the police that he was dragging his feet in releasing the report and rather accused them of refusing to cooperate with him, making his work difficult.

He also accused the police of failing to release certain vital information needed to complete the autopsy report.

Based on Dr Edusei’s claims, the court ordered the Director-General of the Criminal Investigations Department (CID) of the Ghana Police Service to furnish the medical officer with all the information he needed to complete the report.

The court also gave Dr Edusei a three-week ultimatum to submit the report to it.

Report submitted

At yesterday’s hearing, the presiding magistrate revealed that the medical officer had complied with the court’s directive.

Following an application by the prosecution, Mr Ansah ordered the court registrar to furnish the police with a copy of the autopsy report for onward transfer to the Attorney-General’s (A-G) Department.

The prosecutor, Deputy Superintendent of Police (DSP) Mr George Amegah, said the police were still waiting for the A-G to furnish them with legal advice on the case for committal proceedings to commence.

Hearing continues on December 12, 2017.

Background

Major Mahama was lynched at Denkyira-Obuasi in the Central Region on May 29, 2017.

The Assembly Member for Denkyira-Obuasi, William Baah, and 21 others have been arraigned for their alleged involvement in the killing of the military officer.

They have all been charged with murder and conspiracy to commit murder.
