OBJ Clothing Vs Sark Clothing: Sarkodie Refuses To Pay For The Logo-Theft Damage Of GH¢90,000

Information gathered by Razz Newspaper about the copyright case between OBJ Clothing and Ghana’s fastest rapper, Sarkodie over a logo artwork-theft is that the rapper has not settled the plaintiff of the Gh¢90,000 nor even goes to court for the hearing since the summon on October 23, 2013.

The GH¢90,000 was a fee to be paid due to the plaintiff for creating the initial logo-artwork for Sarkodie’s Sark-Collection and also render proper accounts of all shoes, clothing and accessories designed by the plaintiff that has been sold in order to aid the court as to the quantum of damages.

According to sources, the rapper has refused to either settle the designer or even goes to court frequently since he was served with the writ by Akufo-Addo, Prempeh & Co. Chambers (legal advisers and solicitors for OBJ Clothing) for using a re-created logo design of the original design created by OBJ for his (Sarkodie) clothing line, Sark Collection.

“Sarkodie together with his lawyer has been to the hearing of the case for about 3 times and even with that he interchanges with his lawyer. On all three occasions, it is either Sarkodie will be present at the hearing, the lawyer will be absent or vice versa,” our source said.

Meanwhile, our source continued, “the court has ordered both lawyers (for the plaintiff and accused) to agree on a suitable date for the hearing where both parties will be present at the court, but the accused, Sarkodie and his lawyers seem to be on a hide-and-seek game as they have refused to meet with the plaintiff to fix the date.”

Adding, “because they (Sarkodie and lawyers) know that when the date is fixed and they boycott the proceeding, it will go against them and neither are they ready to settle OBJ Clothing the GH¢90,000 they were sued for.”

The last hearing of the case was on Monday, June 15, 2015. The hearing saw the plaintiff, OBJ Clothing and his lawyer, Barrister Kwabena Boye Adjekumhene of Kwakwaduam Chambers; and the accused, Sarkodie, 1stDefendant, Sammy Forson and his lawyer. 2nd Defendant, Dr. Duncan, is said never to have been at either of the hearing since the case began.

Meanwhile, all means to reach the plaintiff, OBJ Clothing and his lawyer, Barrister Kwabena Boye Adjekumhene of Kwakwaduam Chambers and one of the core management members of Sarkodie, Sammy Forson for clarifications and details has proven futile as at press time.

Case History
It would be recalled that Ghanaian fashion designer, Jeremiah Obuobi (OBJ Clothing), had in 2012 initially discussed with Sarkodie the idea of starting a partnership clothing line called, the ‘OBJ-Sark ’ since he (OBJ) intended setting up a fashion design factory which focus would have been accessories, clothing and shoes.

Upon agreement, the plaintiff (OBJ Clothing) according to reports went on to design the logo artwork for the line and waited for a final response from the accused, now Sark-Collection owner to start on full operation.

Until late 2013, when the accused unveiled his fashion line, Sark Collection with a briefly recreated logo artwork of what OBJ had initially created.
