Family Sues A-G


The family of the late Emmanuel Oseiย has filed a suit at the high court against theย Attorney-General and Minister of Justice inย connection with the death of the former.

Also joined in suit are the Inspectorย General of Police and one General Constableย Ibrahim Aminu, an officer of the Policeย Service.

The late Osei died on January 21, 2008ย at the Komfo Anokye Teaching Hospital inย Kumasi as a result of gunshot wounds heย sustained from General Constable Aminuย at the Zongo Police Station in Kumasi.

He had been posted there to do hisย national service with the Ghana Healthย Service when the incident occurred.

The statement of claim attached to theย suit filed by Appiade Chambers in Accra,ย lawyers for the plaintiffs, said Osei died asย a result of the negligence of General Constableย Aminu.

It said the police officer had ‘failed toย exercise due care and diligence in handlingย firearms at a human populated area.’

The statement further posited that Generalย Constable Aminu again failed to actย with care and diligence as to avoid firingย gunshots at the late Osei.

As a result, the family is demandingย from the defendants jointly and severallyย the sum of GHยข 20,191 as special damagesย with interest from due date until date ofย final payment at the prevailing bank rate.

The family also wants the court toย order the defendants to pay general damagesย of GHยข50,000 for the pain and sufferingย of the deceased; GHยข100,000 for theย loss of the expectation of life of theย deceased and GHยข50,000 for the emotionalย stress suffered by Madam Afuaย Mensah, mother of the deceased, the 6-year-ย old daughter of Emmanuel Osei andย others with interest from the date of awardย until date of final payment at the prevailingย bank rate.
