Prosecute Afari-Gyan – Group Tells A-G

The Attorney-General and Minister of Justice is under increasing pressure to charge the Chairman of the Electoral Commission (EC), Dr. Kwadwo Afari- Gyan, for wilfully causing financial loss to the state, following the Supreme Court’s cancellation of the March 3, 2015 district level elections.

One of the country’s leading pressure groups, Movement for Change (MFC), based in the Ashanti Region, has joined calls for the prosecution of all the commissioners of the EC for the constitutional blunder that has cause a huge loss to the nation.

In a statement released to the media and jointly signed by its chairman, Dr. Anthony Nsiah Asare; secretary, Justin Koduah Frimpong; director of operations, Odeneho Kwaku Appiah and communication director, Nana Boakye aka Nana B, the MFC said the EC recklessly commenced the election process without recourse to the law.

‘It is imperative to note that the attention of Dr. Kwadwo Afari-Gyan was drawn to the strict adherence to law regarding the holding of the district assembly and unit committee elections. He was cautioned on several occasions to allow CI 85 to mature before his outfit commences preparatory work ahead of these elections, but disregarded all admonition,’ the MFC pointed out.

The statement also urged the commission members to resign, describing their conduct as arrogant, laden with impunity and recklessness.

‘Members of the Movement for Change are of the view that the law must guide heads of public sector institutions which are accountable to the citizenry.

They must further be prosecuted for wilfully causing huge financial loss to the state,’ the statement added.

The MFC again urged aggrieved candidates who might have suffered any loss to institute a court action against Dr. Afari- Gyan and his colleagues on the EC for acting lawlessly and negligently.

It said Article 45(b) of Ghana’s Constitution makes it mandatory for the EC to demarcate the electoral boundaries for both national and local government elections, while the 51 sets the parameters for the commission’s work through constitutional instruments (CI).

For the pressure group, what it is asking the Attorney- General to do falls in line with calls for people to be held accountable and responsible for their actions and inactions as public office holders, and cited an example of the Wa West Member of Parliament, Joseph Yieleh Chireh.

‘The state as well as candidates, who put themselves up to run for the elections, have suffered huge losses and these losses cannot just be swept under the carpet at a time when the nation is broke and reeling under both economic hardship and this monstrous power crisis,’ the MFC entreated
