Former KATH CEO paid judgement debt from hospital account

A former Chief Executive of the Komfo Anokye Teaching Hospital, Dr Nsiah Asare has been paid an amount of GHȻ717,0002 and GHȻ251.68 for the unlawful termination of his appointment in 2009.

Dr Asare sought a “Garnishee Order” putting on hold KATH’s account with the Universal Merchant Bank.

The Bank was invited by the High Court to explain why an amount of money lodged with the bank in the name of the hospital could not be used to defray judgment debt owed Dr. Nsiah Asare.

The Attorney General’s Department prayed the court to allow more time to get the Ministry of Finance to process and make payment.

The Court gave a grace period of 21 days on January 13 2014 which expired on February 11, the same year.

A source at the Komfo Anokye Teaching Hospital told Luv News’ Erastus Asare Donkor, the debt totaling, GHÈ»717,251.68 has been paid from the hospital’s account.

This comes at a time when the hospital is struggling to pay its pharmaceutical drug suppliers and it said to be in dire need of money to complete its 40-year-old maternity ward.

Dr. Nsiah Asare when contacted did not deny the payment but will not comment further.

Dr. Nsiah Asare instituted legal action after he was asked to proceed on leave upon a change of government in 2009. Prof. Ohene-Adjei was then asked to take over.

Nsiah Asare had all his entitlements (including car, driver) and salary all withdrawn despite a signed contract which was due to expire in October 2010.

On July 2013 a Kumasi High Court ruled in favor of Dr Nsiah Asare.

The court presided over by Justice Kow Amissah Koomson ruled that termination of Dr. Nsiah Asare’s  appointment by the Ministry of health under the instructions of the President was unlawful.

It also found the stoppage of his salary by the then CEO of KATH, Professor Ohene Adjei was also unlawful.

The court ordered that the plaintiff be paid all his entitlements as at January 31 st  2012.

The payment included, salary from April 2010 to January 2012 (CEO salary, 1 house help, driver, 2 security guards) GHÈ» 81, 119.05, Market premium for the same period, GHÈ» 68,275.92, Allowances for the same period, GHÈ» 104,582.45, End of service benefits for 11 years, GHÈ» 111,014.15, Interest from January 2012 to September 2014, GHÈ» 282,260.12.
