KKD case transferred to High Court

The Kaneshie District Court has committed ace broadcaster, Kwasi Kyei Darkwa, who is standing trial for rape to trial in the high court in Accra.

His first hearing will be on Wednesday March 18, 2015.

The District Court judge, justice Adjoa Akyamaa came to the decision after the state prosecution led by Maalike Woanya, read the bill of indictment which narrated the events preceding and following the alleged rape.

The prosecution insists they have enough evidence to successfully prosecute the case per the content of the bill of indictment

The defence lawyer Anthony Forson in a rebuttal prayed the court to refuse to commit his client saying the prosecution did not hold any credible evidence to go ahead with the trial.

Forson cited the letter written by the victim to the AG as enough grounds for dismissal.

He told the court the bill of indictment as read by the prosecution could not stand as evidence, especially because they would not have the victim to confirm it.

But in her ruling Justice Adjoa Akyamaa Ofosu said her court has no power to determine evidence of a prima facie hence her decision to transfer it to the high court.
