Two Ghanaians, who stood sureties for Alistair Jude Mathias, a Canadian businessman before he was granted bail by the Criminal Investigation Department (CID) of the Ghana Police Service, have been ordered by an Accra Circuit Court to produce him on October 15, 2014.
Readers will recall that in the Monday, September 15, 2014 edition of DAILY GUIDE, a publication headlined, ‘Canadian Dupes Ghanaian Businessman $4m,’ indicated, among other things that ‘a Ghanaian businessman who has been dealing in gold for some years now was allegedly defrauded by his Canadian business partner to the tune of $4 million.’
Mr. Alistair Mathias was reported at the CID Headquarters in Accra by his Ghanaian business partner Henry Osei barely two months ago.
The former was subsequently arrested for interrogation by the CID and was put behind bars, only to be granted bail a few hours later with two sureties.
This was confirmed by the investigator of the case, Inspector Ansah, who disclosed to this paper that Alistair had travelled to Dubai, the United Arab Emirates after his bail. According to the police officer, he (Alistair) was going to bring documents on the business transactions between him and Mr. Henry Osei.
Having waited patiently for almost two months without the Canadian – who is domiciled in Dubai – showing up, the police dragged the sureties – Messrs Mustapha Gande, who is said to be special assistant to the Chairman of the National Democratic Congress (NDC), Kwabena Adjei and parliamentary aspirant, as well as Joel Nettey, President, Advertising Association of Ghana, who doubles as Chief Executive of Innova DDB Ghana – to court for the necessary action to be taken.
When the case was called on Thursday, September 25, 2014 in the court presided over by Mr. Boakye Yiadom, only one of the sureties, Mustapha Gande (1 st surety) turned up. Counsel for the sureties, Dennis Adjei Dwomoh argued that Joel Nettey had not been served with the application, saying the service should have been done through a bailiff.
The prosecutor, ASP Cletus Amanor and other lawyers drew counsel’s attention to the fact that once the case was in the hands of the police, the service was not to be done through a bailiff.
Mr. Adjei Dwomoh then gave the assurance that he would produce the second surety (Mr. Nettey) the following day – Friday, September 26, and prayed the court to grant the first surety self-cognizance bail.
Mr. Boakye Yiadom therefore adjourned the case and granted Mr. Mustapha Gande bail in the sum of GH¢2 million with three sureties.
At the Friday sitting, Adjei Dwomoh came with both sureties – Gande and Nettey. He prayed the court to grant Mr. Nettey self-cognizance bail, indicating that being the President of the Advertising Association of Ghana and businessman, his client would not absent himself from subsequent court hearings.
Asked when Mr. Alistair Jude Mathias could be produced in court, Mr. Dwomoh disclosed that plaintiff, Mr. Henry Osei, had sent the case to a court in Dubai and for that matter, his client was in that country because of that (case).
The court eventually granted the two sureties bail in the sum of GH¢500,000.00 each with two sureties. They were asked to come back on October 15 with Alistair Jude Mathias.
