Court To Rule On Richard Nyamah’s Locus Today

An Accra High Court presided over by His Lordship Justice L.L Mensah will today, Tuesday May 13, 2014 rule on an application filed by the Attorney General’s Department questioning the locus of New Patriotic Party’s Richard Nyamah over his law suit against the state.

Richard Nyamah is suing government for its indebtedness to the Ghana Education Trust Fund (GETFund).

According to him, the Ministry of Finance has since 2013 failed to pay the compulsory percentage of VAT returns into the GETFund accounts as required by law.

This, he claimed has halted the GETFund’s expansion of infrastructural development and sponsoring of Ghanaian students pursuing further studies abroad.

The Attorney General’s Department in their application in opposition claimed Richard Nyamah had no locus as an individual to sue the state for which reason his law suit should be dismissed.

However, Lawyer Shean Poku, Counsel for Richard Nyamah at the last sitting argued that his client was qualified as a citizen to pray the court to compel the Ministry of Finance to defray the accumulated debt owed GETFund.

His Lordship Justice L.L Mensah is expected to either uphold or dismiss Richard Nyamah’s law suit.
