{"id":749,"date":"2013-01-10T17:54:58","date_gmt":"2013-01-10T17:54:58","guid":{"rendered":"http:\/\/ghana-mma.com\/2013\/01\/amissah-arthur-calls-for-amendment-of-transition-act\/"},"modified":"2013-01-10T17:54:58","modified_gmt":"2013-01-10T17:54:58","slug":"amissah-arthur-calls-for-amendment-of-transition-act","status":"publish","type":"post","link":"https:\/\/www.ghanamma.com\/2013\/01\/10\/amissah-arthur-calls-for-amendment-of-transition-act\/","title":{"rendered":"Amissah Arthur calls for amendment of Transition Act"},"content":{"rendered":"<div id=\"story_photo\">\n<div class=\"image-frame\"><img decoding=\"async\" src=\"http:\/\/img.ghanamma.com\/uploads\/2013\/01\/573c604613149_134221.jpg\" title=\"Amissah Arthur calls for amendment of Transition Act\" alt=\"Amissah Arthur calls for amendment of Transition Act\" \/><\/div>\n<p class=\"caption\"><span class=\"caption-text\">Paa Kwesi Amissah- Arthur, Vice Prsident<\/span><\/p>\n<\/div>\n<p><span class=\"story_text_1\">The Vice President and Head of the transitional team, Papa Kwasi Amissah-Arthur is proposing the amendment of the Transition Act 845 which makes provisions for the transfer of political power from one democratically elected President to another.<\/p>\n<p>He said the Act made no provisions for the transfer of power from an incumbent government to itself as happened in the case of President Mahama.<\/p>\n<p>Speaking to the press in Accra, Mr. Amissah Arthur said \u2018\u2019we have identified quite a number of areas where we have to hopefully revise and amend the law Act 854.\u2019\u2019<\/p>\n<p>He stated that \u2018\u2019the Act 845 assumes that somebody will be in power and another person would have won the election and that\u2019s the assumption.\u2019\u2019<\/p>\n<p>He indicated that \u2018\u2019in every election where the president may win his re-election like it has happened now, the composition assumes that two president\u2019s one an incumbent and the incoming would have to form a transition team.\u2019\u2019<\/p>\n<p>He further added that \u201cincumbent specifies which ministers will be members from his side and then the incoming president because he wouldn\u2019t have ministers at that time will then propose an equal number of people.\u201d<\/p>\n<p>He therefore called for a better clarification of all the provisions contained in the Act as well as a re-consideration of the provisions in the Transition Act.<\/p>\n<p>According to him, \u201cthe first provision that needs re-consideration is in relation to the swearing in of parliament.\u201d<\/p>\n<p>\u201cAccording to law 845 there were two parliaments in Ghana in the last two days which is not what the constitution expects.\u201d<\/p>\n<p>The constitution states \u2018\u2019that parliament will be in existence for exactly four years from 7th January and on the 4th anniversary on the midnight it is dissolved and then a new one is formed,\u2019\u2019 He added.<\/p>\n<p>Paa Kwasi Amissah Arthur also stated that the transition team \u201dtried to get around that by saying that you have to swear the oath and then two days later it will become effective. A lot of lawyers said this is a very an impractical way of addressing an issue.
