Tsatsu/Addison Clash In Court

Mr Tsatsu Tsikata, Counsel for third Respondent and Mr Philip Addison, Counsel for the Petitioners engaged in hot exchanges over a 74- page list in the P-series which Mr Tsikata claimed was full of errors.

The confrontation between the two counsels started following unsavoury comments made by Mr Tsikata about the P-series lists, which did not go down well with Mr Addison.

Mr Tsikata stated that the respondents had rejected the error full list on three occasions, and that, that would be the last.

He said the respondents would not dignify “this worthless P-series with anymore of their time” adding that when the petitioners offer to tender the document they would not object to it in any way for all its worth.

Dr Bassit Bamba, who held brief for Mr Tony Lithur, Counsel for first respondent, associated himself with the views expressed by Mr Tsikata. Mr James Quarshie Idun, Counsel for second respondent said whatever document is brought by the petitioners, they are ready to have it tendered.

Mr Philip Addison, Counsel for the petitioners, who did not like the comments made by Mr Tsikata, said the petitioners IT staff went through great pains in compiling the document but with the pressure on their heads they omitted some information, which affected the entire list.

He expressed surprise at the conduct of Mr Tsikata, claiming that the petitioners spent two weeks with the respondents over their duplicated and triplicate documents.

He stated that Mr Tsikata used more than 4000 pink sheets in his cross examination of the petitioners’ witness and in all that the petitioners cooperated with them.

Mr Addison said he finds it strange that Mr Tsikata would now turn around to complain that his time is being wasted.

Mr Addison continued his cross-examination of Dr Kwadwo Afari Gyan, Chairman of the Electoral Commission (EC), who is the witness for the second respondent.

He presented 10 different lists of pink sheets to Dr Afari Gyan to identify, which the witness confirmed to be unsigned pink sheets exhibits.

Dr Afari Gyan however made some observations that some of the lists being tendered also contained pink sheets which were signed at the instance of the Returning Officer.

Mr Addison said the caveat by the witness is of no consequence because the petitioners case is about unsigned pink sheets, which the list clearly shows.

He stated that, for Dr Afari Gyan to tell the court that he has some original copies, which have been signed, is immaterial to their case.
Mr Addison suggested to witness that the exhibits tendered were not included in the list of 905 the EC claimed were unsigned.

Mr Addison also provided the witness with another lists and asked him to see if they are part of the 905 unsigned pink sheets. Dr Afari Gyan answered by saying he cannot keep a list of 905 polling stations in his head to cross check.

Mr Addison protested at the language used by Dr Afari Gyan compelling Justice Vida Akoto Bamfo intervention.

She reminded the witness that whatever answers he gives is to the court and not to Mr Addison. Mr Addison also presented two documents to the witness, who identified them as the Final Voters Register for the 2012 General Election for LA Primary School Adaklo as well as the Afadzato Constituency.

Dr Afari Gyan confirmed that page 45 on the Adaklo Register shows that a name and face have been repeated and that it is double registration.

He said the information is the same but the Voter IDs are different. It means the same person has two Voter IDs. Mr Addison asked the witness to open Page 16 and make out a voter by name Ernest Fie.

He said the name of the voter has been repeated in the Register. Dr Afari Gyan said on the biometric registration there could be double registration but the EC can correct that.

Hearing was adjourned to make way for the live coverage of the Satellites Match
