{"id":449939,"date":"2011-06-29T08:24:14","date_gmt":"2011-06-29T08:24:14","guid":{"rendered":"http:\/\/www.ghanamma.net\/2011\/06\/29\/uk-told-to-keep-somali-criminals\/"},"modified":"2011-06-29T08:24:14","modified_gmt":"2011-06-29T08:24:14","slug":"uk-told-to-keep-somali-criminals","status":"publish","type":"post","link":"https:\/\/www.ghanamma.com\/2011\/06\/29\/uk-told-to-keep-somali-criminals\/","title":{"rendered":"UK told to keep Somali criminals"},"content":{"rendered":"<p><div readability=\"81.0430463576\"><span><span>29 June 2011<\/span> <span>Last updated at<\/span> <span>04:24 ET<\/span><\/span><\/p>\n<p>The UK must not deport two Somalis convicted of serious crimes because to do so would endanger their lives, the European Court of Human Rights says.<\/p>\n<p>The Strasbourg judges said the UK&#8217;s duty to protect the two from torture or inhumane treatment was &#8220;absolute&#8221;.<\/p>\n<p>The pair, aged 24 and 42, were served with deportation orders after being convicted of burglary, threats to kill, robbery and dealing in class A drugs.<\/p>\n<p>The ruling sets a legal precedent for 214 similar UK cases involving Somalis.<\/p>\n<p>Abdisamad Adow Sufi (24) and Abdiaziz Ibrahim Elmi (42) are being held at immigration detention centres in the UK.<\/p>\n<p>In 2007 they appealed to the Strasbourg court, arguing that they would face death or serious injury if the UK deported them to the war-ravaged capital Mogadishu.<\/p>\n<p>The seven judges accepted that there would be a violation of Article 3 (prohibition of inhuman or degrading treatment) of the European Convention on Human Rights if the pair were sent back to Mogadishu.<\/p>\n<p>The <a href=\"http:\/\/cmiskp.echr.coe.int\/tkp197\/view.asp?action=open&#038;documentId=887236&#038;portal=hbkm&#038;source=externalbydocnumber&#038;table=F69A27FD8FB86142BF01C1166DEA398649\" title=\"Court judgment on Sufi and Elmi v UK - pdf\">court ruling<\/a> said the judges &#8220;reiterated that the prohibition of torture and of inhuman or degrading treatment or punishment was absolute, irrespective of the victims&#8217; conduct&#8221;.<\/p>\n<p>&#8220;Consequently, the applicants&#8217; behaviour, however undesirable or dangerous, could not be taken into account.&#8221;<\/p>\n<p><span>UK &#8216;very disappointed&#8217;<\/span><\/p>\n<p>The court told the UK to pay Mr Sufi 14,500 euros (\u00a313,000) and Mr Elmi 7,500 euros (\u00a36,716) for costs and expenses.<\/p>\n<p>The UK still has three months in which it can appeal for the case to be re-examined.<\/p>\n<p>The UK Border Agency said it was &#8220;very disappointed&#8221; at the ruling and was considering its legal position.<\/p>\n<p>&#8220;This judgment does not stop us continuing to pursue the removal of foreign criminals who commit a serious crime,&#8221; it said in a statement. &#8220;Nor does it find that all Somalis are in need of international protection.&#8221;<\/p>\n<p>Somalia has not had a functioning national government for 20 years.<\/p>\n<p>The Islamist al-Shabab group controls much of southern Somalia and has been fighting interim government forces for control of Mogadishu in recent months.<\/p>\n<\/div>\n<\/p>\n<p>More:<br \/>\n<a target=\"_blank\" href=\"http:\/\/www.bbc.co.uk\/go\/rss\/int\/news\/-\/news\/world-europe-13956008\" title=\"UK told to keep Somali criminals\" rel=\"noopener noreferrer\">UK told to keep Somali criminals<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p> 29 June 2011 Last updated at 04:24 ET The UK must not deport two Somalis convicted of serious crimes because to do so would endanger their lives, the European Court of Human Rights says. <\/p>\n","protected":false},"author":0,"featured_media":449940,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[3],"tags":[],"class_list":{"0":"post-449939","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-entertainment"},"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.0 -
