A new seven-member jury was on Wednesday sworn in to hear afresh the case involving three soldiers accused of murdering Alhaji Issa Mobilla.<\/p>\n

It replaces the seven-member jury which was changed after the trial judge was prohibited from continuing to hear the case involving Corporal Yaw Appiah, Private Eric Modzaka and Private Seth Goka.<\/p>\n

Appiah and Modzaka, who were clad in white shirts, have pleaded not guilty to two counts of conspiracy and murder of Alhaji Mobila, a former Northern Regional Chairman of the Convention People\u2019s Party (CPP), on December 9, 2004.<\/p>\n

Goka, who is on the run, is being tried in absentia.<\/p>\n

A five-member prosecution team, led by a Chief State Attorney, Mrs. Merley Wood, is expected to call the first prosecution witness before the new judge, Mr. Justice Mustapha Habib Logo, on July 7, 2011.<\/p>\n

Addressing the jurors, counsel for the accused persons, Mr. Thaddeus Sory, pleaded with them to act according to their conscience and apply the rules in accordance with the oath they had sworn, so that justice would be served.<\/p>\n

The facts of the case are that Alhaji Mobilla was placed in custody by the police on December 9, 2004, for allegedly supplying the youth in Tamale with guns to foment trouble.<\/p>\n

While he was in custody, the police claimed that they received information that his followers and sympathisers were mobilising to free him.<\/p>\n

Alhaji Mobilla was consequently transferred from police cells to the Kamina Military Barracks and handed over to the three accused persons.<\/p>\n

According to the prosecution, Alhaji Mobilla died in military custody three hours after he had been handed over to the accused persons who were on duty that day.<\/p>\n

The Chief pathologist\u2019s report revealed that Alhaji Mobilla was sent to the hospital dead and that he died as a result of collapsed lungs; fractured ribs and severe abrasions.<\/p>\n

Appiah and Modzaka, who have been in custody for the past five years, were sent from Tamale to face trial in Accra.<\/p>\n

They were put before Mr. Justice Senyo Dzamefe in early 2010. Nine witnesses were called before the foreman of the jury fell ill.<\/p>\n

His ailment necessitated Mr. Justice Dzamefe, who had then been promoted to the Court of Appeal, to replace the foreman.<\/p>\n

That action sparked a sharp disagreement from counsel for the accused persons, who argued that the replacement of the juror in law meant that the case had started afresh.<\/p>\n

Counsel, therefore, argued that because the trial judge had failed to produce any document to prove that he had been re-appointed to hear the case, he should recuse himself from the case.<\/p>\n

Following the judge\u2019s refusal to recuse him, counsel went to the Supreme Court and prayed it to prohibit the judge.<\/p>\n

The Supreme Court, on March 16, 2011, quashed Mr. Justice Dzamefe\u2019s decision to continue sitting on the case, after the foreman of the seven-member jury had been replaced due to ill-health.<\/p>\n

In a unanimous decision, the court prohibited the judge from further hearing the case on the grounds that he lacked the jurisdiction to hear afresh the suit against the accused persons after he was elevated to the Court of Appeal.<\/p>\n
