{"id":445884,"date":"2011-06-22T19:31:18","date_gmt":"2011-06-22T19:31:18","guid":{"rendered":"http:\/\/www.ghanamma.net\/2011\/06\/22\/dismiss-ukachukwu%e2%80%99s-petition-sen-uba-urges-tribunal\/"},"modified":"2011-06-22T19:31:18","modified_gmt":"2011-06-22T19:31:18","slug":"dismiss-ukachukwus-petition-sen-uba-urges-tribunal","status":"publish","type":"post","link":"https:\/\/www.ghanamma.com\/2011\/06\/22\/dismiss-ukachukwus-petition-sen-uba-urges-tribunal\/","title":{"rendered":"Dismiss Ukachukwu\u2019s petition, Sen Uba urges tribunal"},"content":{"rendered":"<div readability=\"70\">\n<p><strong>By Innocent Anaba<\/strong><\/p>\n<p>AWKA \u2013 Senator Andy Uba has asked the National Assembly Election Tribunal sitting in Awka, Anambra State, to dismiss the petition by Prince Nicholas Ukachukwu, contending that the tribunal lacked the locus standi to hear his (Ukachukwu) petition, as he was not a candidate of any political party and did not take part in the said election.<\/p>\n<p>According to Uba, the complaint raised in the petition does not qualify as grounds as specified in the Electoral Act 2010, as amended, for questioning the validity of an election.<\/p>\n<p>Ukachukwu, in the petition, had claimed that he was the rightful candidate of the Peoples Democratic Party, PDP, for Anambra South senatorial district polls won by Uba.<br \/>Ukachukwu said he was elected candidate at the PDP\u2019s primaries organised by the party\u2019s NEC in line with its constitution and the Electoral Act.<\/p>\n<p>According to him, the state chapter of PDP ought not to select, elect or nominate a candidate.<br \/>However, Uba is contending in his preliminary objection that Ukachukwu did not go through the primaries in accordance with PDP Constitution , adding that the PDP Constitution provided that it was the local government area congress in Anambra State Chapter that had the right to elect national and state assembly candidates.<\/p>\n<p>He argued: \u201cThe National Executive Committee and National Working Committee of the PDP had purported to set up a panel which they tagged Waku Panel.<\/p>\n<p>\u201cIt is contrary to the constitution of the party and it impedes Anambra State Executive Committee from participating and\/or overseeing the election of the national\/state assemblies candidates for the party.\u201d<\/p>\n<\/div>\n<p>Comments are moderated.
