Michael Ofosu Frimpong, a prosecution witness in the Amina Yutong mass rape saga, is likely to be recalled by an Accra Circuit court to substantiate an allegation he made in the media that he was coached by the Attorney General\u2019s Department to frame up some New Patriotic Party (NPP) chieftains as having attempted to bribe him over the Amina case.<\/p>\n
Andy Appiah Kubi, counsel for Amina, yesterday at the court presided over by Mrs. Patience Mills-Tetteh, moved a motion to seek leave from the court to apply for Ofosu Frimpong, the fourth prosecution witness, to come and give a vivid account of the said interaction he had with the Attorney-General (AG), for the court to ascertain whether the evidence he gave to the court could be relied on.<\/p>\n
It would be recalled that Ofosu Frimpong, a trader, made allegations in an open court that some members of the NPP attempted to bribe him over the Amina Mohammed case.<\/p>\n
The young man, who had earlier spoken on Adom FM in Tema and Great FM in Accra, claiming he was on the Yutong bus that was attacked at Kubease near Ejisu in the Ashanti region, and on which the mass rape incident occurred, surprisingly added that he was persuaded by Adom FM to add some information to Amina\u2019s claim to make the information credible.<\/p>\n
The prosecution witness claimed that renowned criminologist Professor Ken Attafuah and Andy Appiah-Kubi, both lawyers of Amina, the lady at the center of the controversy, took him to NPP headquarters at Asylum Down, Accra where he met three party bigwigs- Jake Obetsebi-Lamptey, Kennedy Agyapong and Yaw Osafo Marfo- and in a meeting, they promised him GH\u00a290,000 if he helped clear Amina and Adom FM after showing him some money.<\/p>\n
According to him, the NPP officials saw it as an opportunity to nail government over a promise to reduce armed robbery in the country.<\/p>\n
Because he was afraid, he informed his pastor who advised him not to tread that path and that he (pastor) was aware of a similar incident in which the person testified but did not reach home with the money, as he was attacked.<\/p>\n
Mr. Appiah Kubi recalled that he gave this evidence on March 18, 2011 and was cross-examined, after which he was discharged.<\/p>\n
However, subsequent to this, Ofosu granted an interview to the media, alleging that he was motivated and coached by the AG to lead such evidence.<\/p>\n
Counsel observed that such evidence, as allegedly promoted through the witness by the AG, is already in evidence as part of the proceedings in this court.<\/p>\n
The statement given to the media, counsel noted, \u201cis relevant for the purpose of ascertaining the competence and credibility of the witness and the value of the witness evidence in court. It is for this reason that my lord we find it appropriate and imperative to seek leave to apply to recall the witness\u201d.<\/p>\n
Counsel, who informed the court that he had served Paul Asibi Abariga, the state Attorney in the case and that the application was on notice, added that \u201cit would interest the court to know the state has not filed an affidavit in opposition spring the pleasant surprise that the state agrees with us\u201d.<\/p>\n
He stressed that in the interest of justice, Amina should be allowed to marshal all the necessary resource to defend herself in this matter.<\/p>\n
Mr Abariga, after this submission by counsel, informed the court that he would file his response to the motion accordingly to be moved on a later date.<\/p>\n
The trial judge also made an order that one Isaac Akudago, a worker with Priceline Consult Limited, owners of the \u2018Amina\u2019 Yutong bus, should provide evidence of payment of Social Security contribution on his behalf and other employees by Priceline Consult for the defence to continue their cross-examination.<\/p>\n
This followed a request by Mr. Appiah Kubi in order to test his (Akudago) credibility as a worker of the company and his representation in court on the company\u2019s behalf.<\/p>\n
Counsel, during cross-examination, observed that the witness\u2019s lack of knowledge of his own relationship to the company raised doubts about his credibility and that of the company he represented, hence the request for the order.<\/p>\n
Mr. Abariga had objected to this order, saying it was irrelevant because the witness never said he was representing the company.<\/p>\n
However, the court gave the order.<\/p>\n
Mr. Abariga however prayed the court to direct the order at the company since the witness was not in a position to provide any details concerning other colleagues but the judge did not oblige this request. Mrs. Mills Tetteh advised the witness to still come to court even if he does not get these documents.<\/p>\n
Amina captured national attention following her statement on Adom FM, a Tema-based radio station that there was a mass rape of women on a Bawku-bound bus during a robbery attack at Kubiase.<\/p>\n
The mother of three children claimed the armed robbers forced male passengers to have sex with their female counterparts, including a father who was supposedly forced to sleep with his 14-year-old daughter.<\/p>\n
Amina, who is standing trial for causing fear and panic, as well as deceit of public officer, has pleaded not guilty to the charges and is currently on a GH\u00a25,000 bail with a surety.<\/p>\n
Meanwhile, all the six witnesses called by the prosecution have indicated that indeed there was a robbery attack but they escaped narrowly.<\/p>\n<\/div>\n
