Momodou Colley, the Director of Physical Planning and the fourth defence witness (DW4) in the case of Barrister Moses B Johnson Richards’, who is standing trial on two counts of alleged criminal offences i.e. giving false information and sedition, on Thursday, 16th June, continued to testified before acting Principal Magistrate Alagbe Taiwo Ade of the Banjul Magistrates’ Court.<\/p>\n

In his testimony, Colley told the court that the panel which was constituted by the then Chief Justice, Abdou Karim Savage, the late Director General of the National Intelligence Agency (NIA) Pa, Jallow, the then minister of Justice and Attorney General Kebba Sanyang, the then director of operation at the NIA Demba Sowe, Mr.. Faye, one of the directors of NIA, Dodou Mboob, Haruna Jaiteh, Hamidou Jallow, Commissioner Bojang, representing the Inspector General of Police and himself (DW4).<\/p>\n

“What were you asked to do?” asked Senior Counsel Antuman Gaye.<\/p>\n

In response Colley said they were to work in order to see that the order of the court is executed without any problem.<\/p>\n

Gay e asked “Tell the court were the directive came from?”<\/p>\n

“I wouldn’t know that. I only received a letter and I wouldn’t know where it come from” said Colley.<\/p>\n

He told the court that he attended the meeting of the judiciary in which he was invited. He added that a small committee was formed under this panel, comprising four of them and that they were tasked to find out the location (Jabang) were the execution was supposed to take place and report back to the panel. He said whilst at the meeting before leaving for Jabang, they were given a sketch plan which was executed in the court order.<\/p>\n

When asked by defence counsel Gaye whether Exhibit B was the sketch plan, the witness responded in the affirmative.<\/p>\n

He said when they went to Jabang they found out that one of the portion of Exhibit B falls in a forest reserve and that it is still in the forest.<\/p>\n

Colley said after visiting the place they prepared a report and sent it to the panel and that the report is with him in court.<\/p>\n

“Is the report signed by anybody?” asked Lawyer Gaye.<\/p>\n

“I signed it”, replied Colley.<\/p>\n

“Is it dated?”<\/p>\n

“Yes, it is dated.” said Colley, adding that it the original report.<\/p>\n

At this juncture, Gaye applied to tender the said report in evidence as exhibit but State Counsel Morris Agiah objected to the admissibility of the document on the grounds that it is emanating from a panel of enquiry.<\/p>\n

“These document sought to be tendered cannot be the original because it was submitted to the panel,” Agiah submitted.<\/p>\n

He finally urged the court to reject the application made by the defence to tender the document.<\/p>\n

Replying to the objection made by the State Counsel, Senior Counsel Gaye said the objection is misconceived and that the document sought to be tendered is an original document and it is signed by the witness who is at the same time the author of that document. He further argued that the same witness has told the court that he is the Director of Physical Planning.<\/p>\n

Gaye further submitted that the document sought to be tendered is emanating from proper custody and that it is admissible under the Evidence Act and that section 115 of the said Act talks about certified copies and that the situation at hand is a different thing because the witness has come to court to tender his making and therefore there is no need for a certified copy.<\/p>\n

Gaye further submitted that by virtue of section 98 subsection (4) of the Evidence Act the document sought to be tendered is admissible in evidence as primary evidence. He read out the said section to back his argument and referred the court to the case of Jallow versus Jallow of the Gambia Court of Appeal decision.<\/p>\n

State counsel Agiah re-argued that the section cited by the defence is not applicable and that the document sought to be tendered is a public document.<\/p>\n

The trial Magistrate ruled that the document is admitted in evidence as Exhibit B and the objection raised by the state counsel is overruled.<\/p>\n

Hearing continues on the 27th of June, 2011.<\/p>\n
