{"id":439249,"date":"2011-06-10T09:26:44","date_gmt":"2011-06-10T09:26:44","guid":{"rendered":"http:\/\/www.ghanamma.net\/2011\/06\/10\/in-nia-6-appeal-case-high-court-discharges-salamina-drammeh\/"},"modified":"2011-06-10T09:26:44","modified_gmt":"2011-06-10T09:26:44","slug":"in-nia-6-appeal-case-high-court-discharges-salamina-drammeh","status":"publish","type":"post","link":"https:\/\/www.ghanamma.com\/2011\/06\/10\/in-nia-6-appeal-case-high-court-discharges-salamina-drammeh\/","title":{"rendered":"In NIA 6 Appeal Case High Court Discharges Salamina Drammeh"},"content":{"rendered":"<div readability=\"101.558579697\">\n<hr class=\"thin clear\" \/>\n<hr class=\"thin clear\" \/>\n<p><a href=\"http:\/\/www.observer.gm\/enews\/\" target=\"_blank\" rel=\"noopener noreferrer\">The Daily Observer<\/a> (Banjul)<\/p>\n<p>Sidiq Asemota<\/p>\n<p>9 June 2011<\/p>\n<hr class=\"thin clear\" \/>\n<p>Justice Emmanuel Amadi of the High Court in Banjul, yesterday, Wednesday, 8th of June 2011 acquitted and discharged Salamina Drammeh, and upheld the Lower Court&#8217;s conviction against five jailed former NIA officials.<\/p>\n<p>Justice Amadi&#8217;s decision came following the ruling he delivered yesterday in the criminal appeal case involving the six jailed former NIA officials against the state. The six officials are Lamin Drammeh, Basiru Jabang, Kajali Jawara, Lamin Sanneh, Fabakary Barrow and Salamina Drammeh. They were convicted and sentenced by Fatou Lili Drammeh, the principal magistrate at the Kanifing Magistrate&#8217;s Court on the 6th of December 2010 on four counts of conspiracy to commit felony, theft, abuse of office and criminal trespass.<\/p>\n<p>According to the particulars of the offence, the accused allegedly conspired among themselves on the 23rd of June 2004 and entered Room F15 at the Senegambia Beach Hotel, stole from a German national, Dr. Frank Mahler, the sum of US$205, 600, D1100, Siemens mobile phone and also stole eight diamond stones from another German national, Niklas Westphal, Nokia 6310, stainless steel pocket tool and AC\/DC travel shaver.<\/p>\n<p>The appellants were also alleged to have, on the 23rd of June 2004 at Senegambia Beach Hotel, while being employed in public service as National Intelligence Agency officials, abused the authority of their office, carried out arbitrary acts prejudicial to the right of both Dr. Frank Mahler and Niklas Westphal. The appellants were further alleged to have entered the property in the possession of another with intent to intimidate Dr. Frank Mahler and Niklas Westphal on the 23rd June 2004 at the Senegambia Beach Hotel.<\/p>\n<p>The trial magistrate at the Kanifing Magistrate&#8217;s Court, Fatou Lili Drammeh convicted all the appellants on four counts, except Salamina Drammeh on the fourth count of criminal trespass. On the count of conspiracy, they were sentenced to serve three years imprisonment with hard labour. On the count of theft, Lamin Drammeh, Basiru Jabang, Kajali Jawara, Lamin Sanneh, and Fabakary Barrow were convicted and sentenced to serve four years jail term with hard labour.<\/p>\n<p>Whilst on count three, on the count of abuse of office, the six appellants were each sentenced to jail terms of three years. On the final count, four of the appellants: Lamin Drammeh, Kajali Jawara, Lamin Sanneh and Fabakary Barrow were sentenced to one year imprisonment each, and the sentences should run concurrently. Dissatisfied with the Lower Court&#8217;s decision, the appellants filed an appeal before the High Court in Banjul, presided over by Justice Emmanuel Amadi.<\/p>\n<p>Delivering judgment yesterday, Justice Emmanuel Amadi defined conspiracy and stated that in proving the case of conspiracy, there must be meeting of the minds. He disclosed that the count of conspiracy and criminal trespass was proven adequately against the appellants at the Lower Court to warrant their conviction. The presiding judge therefore acquitted and discharged the appellants on the charge of conspiracy and abuse of office. The presiding judge pointed out that from the totality of the evidence adduced before the court, he had found nothing against the appellant, Salamina Drammeh, and he was cleared of all the counts and acquitted and discharged.<\/p>\n<p>Justice Amadi however affirmed the Kanifing Magistrates Court&#8217;s decision on the count of theft punishable with four years jail term and on criminal trespass punishable with one year imprisonment. Following the acquitting and discharge of the 6th appellant, Salamina Drammeh, by the High Court judge, state counsel Ebrima Jaiteh invoked the powers of the Attorney General to remand the appellant, Salamina Drammeh, under Section 285 (E) of the CPC, pending the determination of the appeal.<\/p>\n<p>In his response, appellant counsel L.S. Camara submitted that equity cannot override the statute. L.S. Camara however submitted that the 6th appellant, Salamina Drammeh, be granted bail by the High Court, referring the court to an unreported case, criminal case, HC 517\/09\/CR\/143\/AO. The said Salamina Drammeh was granted bail in the sum of D500, 00 with one Gambian surety.The judge pointed out that the surety must be a Gambian who has a landed property in Banjul or in the Greater Banjul Area.<\/p>\n<p>Justice Amadi further pointed out that the surety should deposit their national ID card and passport with the Registrar of the High Court.
