The Deputy Director of Civil Litigation and the prosecutor in the criminal trial of Pristine Consulting Company, Mr. Simon Abi, on Thursday 2 June, informed Justice Joseph Ikpala of the Special Criminal Court at the Banjul High Court that the State intends to negotiate and settle the case out of court.<\/p>\n

The State counsel said this after applying for a two week adjournment to enable the State to come up with their proposal.<\/p>\n

The defence counsel Madam Ida Drammeh did not object to the State’s proposal.<\/p>\n

Justice Ikpala then adjourned the case to 16 June for the out of court settlement of the case based on the consent of both counsels.<\/p>\n

It could be recalled that Pristine Consulting Company (first accused), Mr. Abdourahman Touray (second accused) and Mr. Hassan Touray (third accused) are jointly charged with two counts of “Economic Crimes”, one count of “Conspiracy to Defraud the Public” and one count of “Theft”. The second accused person, Mr. Abdourahman Touray is said to have absconded out of the jurisdiction.<\/p>\n

The Statement of offence on count one indicates “Economic Crime”, contrary to section 5 (B) of the Economic Crime Decree specified offences Act. The Particulars of offence states, Pristine Consulting, Abdourahman Touray and Hassan Touray, between 28 April 2009 t0 10 March 2011, being persons engaged by the government of The Gambia to produce ID Cards and other official documents sold intentionally and withheld the government share in the sum of D27, 601. 90 (Twenty Seven Million, Six Hundred and One Thousand and Ninety Dalasi), thereby caused the government economic loses.<\/p>\n

The Statement of offence on count two indicates, “Economic Crime”. The Particulars of offence states that the three aforesaid accused persons between 28 April 2009 to 10 March 2011, being engaged by the government to procure and supply finger print scanner machines and accessories intentionally failed to procure and supply as agreed, thereby committed acts detrimental to the economy of The Gambia.<\/p>\n

The Statement of offence on count three indicates, “Conspiracy to Defraud the Public”, contrary to section 292 0f the Criminal Code. The Particulars of offence states that the three accused persons between 28 April 2009 and10 March 2011 conspired among them to defraud the public by printing and selling to members of the public, ID Cards, Driving Licenses and Residential Permits, all of which contains biometric data in a chip.<\/p>\n

The Statement of offence on count four indicates, “Theft”, contrary to section 252 of the Criminal Code. The Particulars of offence states, “Pristine Consulting, Abdourahman Touray and Hassan Touray between 28 April 2009 and 10 March 2011 received on behalf of the government of The Gambia the sum of D27, 601. 90, and converted it to their personal use, thereby committed an offence”.<\/p>\n

In a similar, but separate development, the civil suit filed by Pristine Consulting Company against the Government before Justice Emmanuel O. Fagbenle of the Banjul High Court could not proceed and was also adjourned to 16 June. Both the State and defence counsels were seen within the Court premises and entering the Chamber of the trial Judge. This reporter gathered that both counsels have agreed for the matter to be heard on the same day as that of the criminal case.<\/p>\n

Readers would recall that Pristine Investment Company Limited (Trading as Pristine Consulting) has filed a civil suit against the Minister of Finance and Economic Affairs (1st Defendant) and the Attorney General of The Gambia (2nd Defendant).The plaintiff is claiming the sum of “US$ 437,798.00, being infrastructural cost agreed to be paid in a contract between them and The Government of The Gambia; the sum of GMD 26,850.897.00, being the contractual deficit based on the minimum sums guaranteed under the contract and the actual documents produced as at the 31 day of March 2010; the sum of GMD 18,865,717.00, being the contractual deficit based on the minimum sums guaranteed under the contract and the actual documents produced as at the 31 day of March 2011 and the Interest rate of 24%( percent) per annum from the date the sums became due under the contract.<\/p>\n
