Ceesay<\/p>\n<p>14 May 2011<\/p>\n<hr class=\"thin clear\" \/>\n<p>The four count criminal case involving the State and Pristine Consulting Company was on Thursday 12 May adjourned to 26 May for hearing following an application for adjournment by the State.<\/p>\n<p>Justice Joseph Ikpala of the Special Criminal Court at the Banjul High Court adjourned the matter after submissions and counter submissions by both the State and the defence.<\/p>\n<p>Representing the State, the Director of Special Litigation, Daniel O. kulo, applied for an adjournment to enable the prosecution to serve the first and second accused persons. He told the Court that they want an order from the Court that will ask the police to enter the Pristine Consulting Company to execute the arrest of any senior official that will enable the appearance of both the first and second accused persons, because they are both facing the same charges. D.O. Kulo asserted that Pristine Consulting Company is one of the accused persons in the case and that they can pick any of the senior staff to appear in court.<\/p>\n<p>State counsel Kulo pointed out that it is not right for the defenc e to object to an adjournment sought by the prosecution because the accused person is in custody. Mr. Kulo stated that the accused person was granted bail by the very Court and the vacation Court also granted him bail. He added that it is now left with the accused person to fulfill the conditions of the bail as stipulated by the Court, adding that he is in custody not on the orders of any Court. He said, &#8220;MY lord, we all know Justice rushed is justice crushed&#8221;. He indicated that the State did not waste any time in proceeding with the matter since it was filed in April.<\/p>\n<p>Mr. Kulo said for the defence to say that the prosecution is applying for an adjournment because they do not have any evidence is out of the question. He asserted that for the defence to say that the State is fond of detaining people, ruined their lives and later withdraw charges against them is misconceived. He added that the defence counsel knows the office of the Attorney General will not do such thing for she has worked with the AG Chambers and knows very well the procedure there.<\/p>\n<p>At this point, defence counsel Ida Drammeh stood up and urged Mr. Kulo to withdraw that statement as she has never worked at the office of the Attorney General in her 31 years of legal practice. State counsel Kulo later withdraw his statement and apologized that he came across a similar name at the AG Chambers and thought that might be Barrister Ida Drammeh.<\/p>\n<p>Justice Ikpala ruled that he has listen to both sides on the argument of adjournment. He said that it is the rule that the case cannot be adjourned for more than two weeks. He went on to over rule the objection raised by defence counsel Ida Drammeh and adjourned the matter to 26 May to enable the first and second accused persons to appear in court and for hearing of the case to commence.<\/p>\n<p>It could be recalled that Mr. Assan Touray, his company and brother Mr. Abdourahman Touray said to be out of the jurisdiction, are charged with two counts of &#8220;Economic Crime contrary to section 5 (B) of the Economic Crimes Decree Specified offences Act&#8221;, one count of &#8220;Conspiracy to defraud the public&#8221; and one count of &#8220;Theft&#8221;.<\/p>\n<p>The third accused person, Assan Touray was arrested and detained. He was granted a Court bail in December, but it was revoked after the prosecution filed fresh information against him. On Tuesday 3 May, Justice Awa Bah, who sat as the vacation judge granted him bail on conditions that he deposits in cash D10 Million with a reputable Commercial Bank, provide two Gambian sureties with landed properties and title deeds within the Greater Banjul valued at D10 Million each and that he should surrender all his traveling documents to the registrar of the Court.
