High Court Judge Projest Rugazia is set to start hearing an application seeking to block the hearing of a suit in which two city residents demand Sh3.5billion compensation from the owner and a contractor of a 10-storey building which collapsed in 2008, destroying their house and business.<\/p>\n

Ms Lalitaben Keshav and her son Ajaykumar Laxman, want the court to dismiss the application in which the owner of the ill-fated building MCSoms Investment Limited and the contractor M\/s N. K. Decorators Ltd, want the court to order the plaintiffs to deposit cash in court as security for cost of the case before it can be heard.<\/p>\n

The question is whether the contractors, N.K. Decorators Ltd who is a Class V builder, can be awarded a contract to erect a multi-storey building worth more than Sh300million in default of the Contractors Registration Board’s rules.<\/p>\n

In their defence to the application for security for costs, the respondents who are the plaintiffs in the main suit, are alleged to deliberately delay the court process because they believe that their arguments in the main suit stand a greater chance of winning as the respondents are liable for the loss for professional negligence.<\/p>\n

Ms Keshav and Ajaykumar operated a business in the name of Coast Printers Ltd.<\/p>\n

The company also has sued the main contractor N.K Decorators Limited over the loss and damage caused by the collapsed building.<\/p>\n

But the plaintiffs insist that MCSoms, being the owner of the collapsed building, was fully responsible for the damage and for failure to abide with construction standards and that they will win the case because the collapsed building was due to the applicant’s negligence.<\/p>\n

Coast Printers Ltd insists that there were no reasonable grounds for the court to halt the hearing because it is evident that the collapse of the building was caused by the defendant’s failure to abide to building protocols, standards and procedures prescribed for the construction of a ten storey building.<\/p>\n
