Sexual and Gender-Based Violence and Persecution (SGBV\/P) among forced migrants who include refugees, asylum seekers, internally displaced persons, smuggled and trafficked people is high. Statistics from UNHCR (January 2011) indicate that there are about 862,551 forced migrants in Uganda.<\/p>\n

An estimate of six out of every 10 clients coming to the Refugee Law Project for psychosocial support have experienced some form of Sexual and Gender-Based Violence and Persecution pre- flight, during flight or in the country of asylum. They come from the Democratic Republic of Congo, Rwanda, Burundi, Somalia, Ethiopia, Eritrea and Sudan, among others. The numbers of clients seeking psychosocial support for SGBV\/P number over 500 between 2010 to date. Key issues include trauma and life-threatening conditions resulting from rape.<\/p>\n

Previous interventions have focused solely on women to address sexual and gender-based violence and persecution. For a long time, men were considered only as perpetrators in need of correction in one way or the other and excluded from the interventions. The limited results of this discriminative process have seen a change in the initiatives on SGBV\/P to bring new actors on board, for example, working with men and boys as partners.<\/p>\n

This work includes joint analysis of structural causes, collective planning and implementation of activities. Various institutions such as cultural, religious, learning institutions, the family, Judiciary and Legislature by action or inaction continue to reinforce structural causes of sexual and gender-based-violence and further reinforce institutionalised sexual and gender-based violence and persecution.<\/p>\n

Forced and early marriages, education of boys only in families, gender blind policies and programmes, entry point to the learning institutions do not bear in mind the challenges of the girl-child, religious teachings which emphasise subordination, fail to teach roles and responsibilities, all do reinforce sexual and gender-based violence and persecution.<\/p>\n

The acknowledgement that in order to address gender-based violence, men will have to be included because they are more powerful within the cultural setup and will legitimately challenge the status quo, makes it is easier to get change. Besides, men already know the structural differences and they can influence policies.<\/p>\n

There are many laws and policies but the implementation is always a challenge. For example, while defilement is a serious crime, there have been reported instances where police receive bribes and settle cases out of court. There is Form 3 for rape and defilement one has to fill when reporting a case and sometimes, the forms are not available at police stations and one is asked to photocopy the form. If a case goes to court, it may take too long and frustrate the survivor who looks at costs and the endangering of the family. For instance, there is usually tension if it is a case between a refugee survivor and a perpetrating national.<\/p>\n

What role are institutions playing in combating SGBV\/P? Are institutions permitting gender-based violence by their actions or inactions or complacency in not doing anything to change the status quo, yet they have the power to do so? What is Parliament, the Judiciary police and other institutions doing? Are the policies being implemented and if not, what is the problem?<\/p>\n
