MINNEAPOLIS (AP)\u2014With the lockout at one month and counting, attorneys for
\nNFL players sat down Tuesday with the federal magistrate who will oversee
\ncourt-ordered mediation with the league later this week.<\/p>\n

Attorneys and Hall of Fame defensive end Carl Eller met with U.S. Magistrate
\nJudge Arthur Boylan for about four hours.<\/p>\n

Boylan \u201cwas very open\u201d and \u201cit was a very constructive session,\u201d said
\nMichael Hausfeld, the lead attorney representing Eller and a group of mostly
\nretired players in their antitrust lawsuit against the owners. Other attorneys
\ndeclined comment.<\/p>\n

The meeting came on the same day the NFL released its 2011 preseason
\nschedule, led by the Hall of Fame Game between Chicago and St. Louis in Canton,
\nOhio, on Aug. 7.<\/p>\n

Whether the games are held remains an open question. The NFL\u2019s attorneys are
\nscheduled to meet with Boylan on Wednesday before mediation begins on Thursday,
\nthe first talks since collective bargaining negotiations broke down March 11,
\nfollowed hours later by the NFL\u2019s first work stoppage since 1987.<\/p>\n

Boylan has a reputation as a problem-solver, though what he can accomplish
\nafter more than two weeks of mediated talks fell short last month in Washington
\nremains to be seen. He has been a magistrate since 1996 and presided over
\nnumerous mediations, including a $195 million settlement between Boston
\nScientific and about 4,000 claims involving heart defibrillators and pacemakers
\nmade by Guidant Corp. in 2007.<\/p>\n

He\u2019ll need to be at his best in this session because the rancor between the
\ntwo sides has grown increasingly bitter as the dispute landed in court.<\/p>\n

\u201cIf the parties would rather take their shot for litigation, you could make
\nthem sit there forever and there still won\u2019t be an outcome,\u201d said Seth Borden,
\na labor law expert at McKenna, Long and Aldridge in New York.<\/p>\n

U.S. District Judge Susan Richard Nelson ordered the mediation on Monday.
\nNelson is still considering an injunction request from the players to lift the
\nlockout imposed by owners after the players dissolved their union, clearing the
\nway for the court fight. Players including MVP quarterbacks Tom Brady<\/a>(notes)<\/a><\/span> and Peyton
\nManning<\/a>(notes)<\/a><\/span> filed the injunction request in federal court here along with a
\nclass-action antitrust suit against the league.<\/p>\n

Retirees, including Eller, filed their own lawsuit, and the cases have been
\nconsolidated.<\/p>\n

\u201cWhat happened today in mediation was for the mediator to become more
\nknowledgeable about positions of the Brady plaintiffs and the Eller plaintiffs
\nand understand their overlap and their positions on respective issues,\u201d
\nHausfeld said.<\/p>\n

Nelson has ordered both sides to keep mediation details confidential, urging
\nboth sides to get \u201cback to the table.\u201d The NFL said it wanted to resume talks
\nwith federal mediator George Cohen in Washington following 16 days of
\nunsuccessful collective bargaining negotiations, but the players wanted to hold
\nany mediation under Nelson\u2019s auspices.<\/p>\n

Nelson\u2019s decision on the injunction could swing leverage in the case one way
\nor the other, so it is unclear how eager either party will be to enter into
\nserious settlement discussions pending her ruling.<\/p>\n

\u201cBoth parties are going to go into this (mediation) balancing what they
\nmight be able to accomplish through direct negotiations against the prospect of
\ngetting something worse than that possibly if the judge is going to rule,\u201d
\nBorden said.<\/p>\n<\/p><\/div>\n<\/p>\n
