A 15-year-old schoolboy stunned a Kadoma magistrate’s court when he claimed he was “playing” when he sodomised a 10-year-old boy.<\/p>\n

The boy and his victim both cannot be named as they are minors.<\/p>\n

The accused pleaded guilty to sodomy when he recently appeared before Kadoma Magistrate Mr Ross Chavi.<\/p>\n

After telling the court that he had been “playing” when he committed the crime, the magistrate ordered that he be punished by receiving four strokes of a rattan cane at the Kadoma reformatory.<\/p>\n

Prosecutor Ms Yvonne Motsi told the court that on the December 31 last year at around 2pm, the complainant was at a cows’ grazing pasture when he was dragged into the bush by the accused.<\/p>\n

The 15-year-old boy sodomised him and then released him. The victim ran home and told his guardians what had happened. They in turn made a police report that led to the arrest of the accused.<\/p>\n

The complainant was taken to Kadoma Hospital for examination and the medical affidavit confirmed that he had been sodomised. In another case, an 83-year-old man is facing charges of raping a nine-year-old girl. Chekani Phiri of Chegutu last week appeared before magistrate Mr Chavi who remanded him in custody to April 8 this year. He was not asked to plead.<\/p>\n

Prosecutor Ms Motsi told the court that on March 11 this year, Phiri allegedly attempted to rape the nine-year-old but she overpowered him and fled.<\/p>\n

Undeterred, the State says, the following day Phiri caught her and raped her once. It is alleged that he threatened to kill her if she told anyone about the rape. The court was told that on March 13 he raped her again but this time three people saw him in the act.<\/p>\n

The three reported to their elders and the latter asked the girl about the alleged abuse, the magistrate was told.<\/p>\n

Allegations are that she disclosed the rape and they made a police report. Prosecutor Ms Motsi opposed bail arguing that Phiri was of no fixed abode and was likely to skip bail if released.<\/p>\n
