{"id":356279,"date":"2011-04-01T06:07:22","date_gmt":"2011-04-01T06:07:22","guid":{"rendered":"http:\/\/www.ghanamma.net\/2011\/04\/01\/kenya-hague-prosecutor-urges-muthaura-to-resign\/"},"modified":"2011-04-01T06:07:22","modified_gmt":"2011-04-01T06:07:22","slug":"kenya-hague-prosecutor-urges-muthaura-to-resign","status":"publish","type":"post","link":"https:\/\/www.ghanamma.com\/2011\/04\/01\/kenya-hague-prosecutor-urges-muthaura-to-resign\/","title":{"rendered":"Kenya: Hague Prosecutor Urges Muthaura to Resign"},"content":{"rendered":"<div readability=\"55.697548387097\">\n<hr class=\"thin clear\" \/><!-- close google_banner_mid div ---><\/p>\n<hr class=\"thin clear\" \/>\n<p>\n<a href=\"http:\/\/www.nairobistar.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Nairobi Star<\/a> (Nairobi)\n<\/p>\n<p><!-- begin story layout piece here --><\/p>\n<p>Isaac Ongiri<\/p>\n<p>31 March 2011<\/p>\n<hr class=\"thin clear\" \/>\n<p>Government spokesman Alfred Mutua yesterday said Head of Public Service Francis Muthaura will not resign as demanded by the ICC prosecutor Moreno Ocampo.<\/p>\n<p>Mutua said that reports indicating that Muthaura was contemplating resigning were speculative. &#8220;Amb Francis Muthaura has not contemplated resigning and has no problem fulfilling the conditions given by the International Criminal Court,&#8221; read a message Mutua posted on his website.<\/p>\n<p><!-- close google_inset_a div ---><\/p>\n<p>Citing unspecified provisions of the international laws, Mutua claims the court cannot arrest people for violating certain conditions before they are indicted.&#8221;This is not accurate because as per international law and basically all laws, you cannot be arrested or held unless you have been indicted,&#8221; Mutua said.<\/p>\n<p>He described as rumours talks of possible arrest of Muthaura and other suspects seen to be violating any of the ICC conditions.&#8221;The summoned have not been charged and the decision to either charge them or not has to come after they have presented their side of the story and a decision is made, several months later,&#8221; he said.
