LAS VEGAS (AP)\u2014Manny Pacquiao\u2019s defamation lawsuit against longtime boxing
\nrival Floyd Mayweather Jr. and others rests on firm allegations and can
\ncontinue, a Nevada federal judge said in a court order Monday that denied a
\nmotion to dismiss the case.<\/p>\n

U.S. District Judge Larry Hicks said Pacquiao has sufficient evidence to
\ncontinue his lawsuit that alleges Mayweather and others acted with malice by
\naccusing the Filipino boxer in a series of interviews of using
\nperformance-enhancing drugs.<\/p>\n

\u201cMoving defendants argue that Pacquiao has failed to sufficiently allege
\nmalice because moving defendants could not have known one way or the other
\nwhether Pacquiao had actually taken PEDs when they made the alleged defamatory
\nstatements,\u201d the order reads. \u201cHowever, the court finds that Pacquiao has
\nsufficiently pled malice in the amended complaint.\u201d<\/p>\n

Pacquiao claimed in the suit that he has never tested positive for any
\nperformance-enhancing drugs, but that Mayweather, Mayweather\u2019s father and uncle,
\nOscar De La Hoya and Golden Boy Promotions\u2019 Richard Schaefer embarked on a
\ncampaign to make people think he used drugs.<\/p>\n

\u201cThe truth did not stop Mayweather and the others,\u201d the suit contends.
\n\u201cThat is because they are motivated by ill will, spite, malice, revenge and
\nenvy.\u201d<\/p>\n

Mark Tratos, a Las Vegas lawyer who represents Mayweather Promotions LLC,
\nsaid the lawsuit was without merit and he would continue to fight for its
\ndismissal. He said the defendants merely questioned Pacquiao\u2019s reluctance to
\nsubmit to drug testing, but stopped short of declaring Pacquiao a drug user.
\nStatements of defamation must consist of facts, not opinions.<\/p>\n

Tratos said Pacquiao would also have trouble proving the defendants acted
\nwith malice, which is required because the famous boxer is a public figure.<\/p>\n

\u201cThe malice standard is very, very high,\u201d Tratos said. \u201cWe do not believe it
\ncan be met by the plaintiff.\u201d<\/p>\n

Schaefer declined to comment on the court order. De La Hoya\u2019s lawyer could
\nnot immediately be reached for comment.<\/p>\n

Pacquiao\u2019s attorney, Dan Petrocelli, said his client\u2019s professional career
\nwould suffer if boxing fans believe he used steroids or human growth hormone to
\nwin titles in seven weight classes.<\/p>\n

\u201cManny has an unblemished reputation and has earned all of his achievements
\nthrough hard work and his natural-born talent and to call him a cheater is
\nsomething he cannot and will not tolerate,\u201d Petrocelli said. \u201cNone of these
\ndefendants have had any evidence to back up the assertion that he has taken
\nperformance-enhancing drugs because he didn\u2019t. It\u2019s very false.\u201d<\/p>\n

Pacquiao\u2019s suit cites various interviews given by the defendants in which
\nthey intimated that Pacquiao\u2019s strength and power were not natural. Among the
\ninterviews cited was an October radio interview in which Mayweather Jr.
\nallegedly said Pacquiao\u2019s physique was different \u201ccause we know the Philippines
\ngot the best enhancing drugs.\u201d<\/p>\n

Pacquiao claimed comments by Mayweather, his father, Floyd Sr., and trainer,
\nRoger Mayweather, were part of a defamation campaign against him.<\/p>\n

\u201cMayweather Jr. and the others set out on a course designed to destroy
\nPacquiao\u2019s career, reputation, honor and legacy and jeopardize his ability to
\nearn the highest levels of compensation,\u201d the suit contends.<\/p>\n

The 2009 suit came as both sides were battling to reach an agreement for a
\nproposed fight between the champion boxers. The negotiations fell apart over
\ndemands by the Mayweather camp that both fighters submit to random blood and
\nurine tests leading up to the bout. Mayweather wanted blood tests up to 14 days
\nbefore the fight, while Pacquiao claimed he feels weak after drawing blood and
\nwould not agree to testing within 24 days.<\/p>\n<\/p><\/div>\n<\/p>\n
