{"id":297071,"date":"2011-03-10T00:02:00","date_gmt":"2011-03-10T00:02:00","guid":{"rendered":"http:\/\/www.ghanamma.net\/2011\/03\/10\/court-clarifies-judgment-on-polls-time-table\/"},"modified":"2011-03-10T00:02:00","modified_gmt":"2011-03-10T00:02:00","slug":"court-clarifies-judgment-on-polls-time-table","status":"publish","type":"post","link":"https:\/\/www.ghanamma.com\/2011\/03\/10\/court-clarifies-judgment-on-polls-time-table\/","title":{"rendered":"Court clarifies judgment on polls time-table"},"content":{"rendered":"<div readability=\"78\">\n<p>\u00a0<\/p>\n<p><span>Mr. Justice Ibrahim Auta of an Abuja Federal High Court yesterday cleared the air on his last Thursday\u2019s decision on the order of election.<\/span><\/p>\n<p><span>The judge said he did not void the election time-table prepared by the Independent National Electoral Commission (INEC) before the National Assembly amended the Electoral Act last year.<\/span><\/p>\n<p><span>Following the amendment of the law, the National Assembly put the presidential election before the governorship poll.<\/span><\/p>\n<p><span>A \u00a0statement by the Deputy Chief Registrar, \u00a0Emmanuel Gakko said Justice Auta did not invalidate INEC time-table.<\/span><\/p>\n<p><span>The clarification is on the purported judgment of the court in a suit filed by the Labour Party (LP) which declared the National Assembly amendment of Section 25 of the Act as \u2018\u201dillegal, unconstitutional, null and void\u201d.<\/span><\/p>\n<p><span>The judge was reported to have declared that the National Assembly had no powers to infringe upon INEC\u2019s powers to fix dates for elections.<\/span><\/p>\n<p><span>Part of the statement reads: \u201cOur attention has been drawn to newspaper reports alleging that His Lordship, the Honorable Justice Ibrahim Auta had on Thursday 3rd March 2011 declared INEC\u2019s timetable for the holding of the April 2011 elections, illegal, unconstitutional, void and of no effect whatsoever.<\/span><\/p>\n<p><span>\u201cFor the avoidance of doubt, in order to put the record straight and to remove the confusion set in public places as a result of the said publication, created by the wrong interpretation and reporting of His Lordship\u2019s Ruling of 3\/3\/2011, we state unequivocally that the content and import of His Lordship\u2019s Order of3\/3\/2011 as follows:<\/span><\/p>\n<p><span>*That Section 25(1) of the Electoral Act, in so far as it repeals the provisions of Sections 76(1), 116(1), 132(1) and 178(1) of the 1999 Constitution is inoperative and void for duplication, inconsistent and lacking legislative competency.<\/span><\/p>\n<p>\u00a0<\/p>\n<\/div>\n<p><img decoding=\"async\" src=\"http:\/\/www.ghanamma.net\/wp-content\/uploads\/2011\/03\/88606cf0thumbnail.php_12.jpg\" \/><\/p>\n<p>See more here:<br \/>\n<a target=\"_blank\" href=\"http:\/\/thenationonlineng.net\/web3\/news\/30374.html\" title=\"Court clarifies judgment on polls time-table\" rel=\"noopener noreferrer\">Court clarifies judgment on polls time-table<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p> \u00a0 Mr. <\/p>\n","protected":false},"author":0,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[],"tags":[],"class_list":["post-297071","post","type-post","status-publish","format-standard"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.0 -
