ALFRED AGBESI Woyome, the embattled self-styled National Democratic Congress (NDC) financier who was to appear at an Accra Fast Track High Court, Commercial Division, over the scandalous payment of GH\u00a258million, yesterday failed to show up.<\/p>\n
The much-publicized case between the Attorney-General and Mr. Woyome came on as scheduled, but journalists who stormed the court with their cameras to take snapshots of the NDC guru were disappointed, as he was nowhere to be found.<\/p>\n
He was however represented by his lawyer, Robertson Kpatsah, when the case was called in the court presided over by Justice Barbara Ackah Ayensu.<\/p>\n
The Attorney-General and Minister of Justice, Martin Amidu, was also not present but was represented by Mrs. Yasmine Armah, who requested more time to study the case which had been filed by the AG.<\/p>\n
According to her, she was only instructed to come for a date, since negotiations between the two parties were still on-going.<\/p>\n
The judge obliged her request and adjourned the matter to January 16, 2012.<\/p>\n
An earlier court presided over by Justice I.O.Tanko Amadu had awarded GH\u00a251, 283,480.59 to Woyome for breach of contract in the renovation of three stadia in Accra and Kumasi for the hosting of CAN 2008 African Cup of Nations tournament. This was after the AG had admitted that Woyome deserved the said amount.<\/p>\n
However, the court ordered the payment of GH\u00a217million as the first tranche to Woyome, with an undertaking to repay the amount should he lose the substantive case, but the Attorney General is reported to have paid an amount of GH\u00a242million to him, flouting the order of the court.<\/p>\n
Speculations were rife yesterday that the former Attorney General, who is now embroiled in the Woyomegate, Betty Mould-Iddrisu, had said that she only asked for the payment of GH\u00a217million as agreed by the court and not the GH\u00a258million that Woyome had pocketed.<\/p>\n
The cash received by Woyome had created a furore, with some people calling for a retrieval of the money because there was no work done by the NDC financier to warrant such a colossal amount. President Atta Mills has asked the Economic and Organised Crime Office (EOCO) to investigate the matter.<\/p>\n
The Attorney-General unfortunately swallowed its own earlier admission that the state owed Woyome GH\u00a242million and subsequently went back to court to seek an order to set aside the judgment and the terms of payment on grounds that they were procured by mistake.<\/p>\n
Their application was dismissed by Justice Tanko after he observed that the document on which the A-G was relying to make the move had been in their possession before the terms of settlement were reached and executed, but the A-G, under Betty Mould-Iddrisu, did not find it sufficiently weighty to constitute a defence.<\/p>\n
The new A-G, Martin Amidu, is now seeking the same reliefs at Justice Ayensu\u2019s court and this application has been in court for the past seven months.<\/p>\n
The A-G is seeking a \u201cdeclaration that the terms of settlement filed in the registry of this court on June 4, 2010 to the effect that the defendant be paid the sum of GH\u00a251,283,480.59 in three equal instalments of GH\u00a217,094,495.53 was procured by mistake.<\/p>\n
\u201cAn order setting aside the said consent judgment filed in the Registry on June 4, 2010 on the grounds that it was procured by mistake\u201d.<\/p>\n
According to the A-G, subsequent to the filing of the terms of settlement, he got information that the terms of settlement had been procured by mistake because the then government, per a letter dated May 4, 2005, signed by Deputy Finance Minster Mr. Agyemah Manu, had stated that Government could not take responsibility and was not liable for any transaction entered into by Woyome.<\/p>\n
The A-G explained that Woyome\u2019s role in the transaction did not create any legal relations with the government of Ghana.<\/p>\n
In defence, Mr. Woyome said there was no merit in the suit and that it was only intended to frustrate the execution of the judgment.<\/p>\n
According to him, based on a letter confirming payment arrangements between the parties, he obtained a loan of GH\u00a24,000,000 from NDK Financial Services Limited where he had to pay 5% interest rate per month.\u00a0\u00a0\u00a0<\/p>\n
Mr. Woyome, who explained that he had since disbursed the amount, argued that the terms of settlement amounted to settlement of the action which was contractual and for that reason the court could hardly interfere with them.<\/p>\n
He also said due to the agreement between the parties concerning the terms of payment, he took a loan of GH\u00a25,500,000.00 from UT Financial Services and that he is entitled to recover the sum of GH\u00a21,000,000.00 being interest paid to the institution occasioned by the failure of plaintiff to pay the first instalment of GH\u00a2 17,094,493.53.<\/p>\n
Woyome, in a counter claim, is seeking an order to obtain interest on the sum of GH\u00a251,283,480.59, on the GH\u00a24,000,000 at 5% per month and also for the state to pay him GH\u00a21,000,000, being interest accrued on the sum of GH\u00a25,500,000 he is owing UT Bank.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n
