The criminal trial involving the state against Andrea Van Roy, a Dutch national, on Tuesday 26th April, 2011, failed to proceed at the Brikama Magistrates Court before Magistrate Hilary Abeke, due to the absence of the accused person.
When the case was mentioned, Kebba Sanyang, the defence counsel for the accused, Andrea Van Roy announced that his client is a remanded prisoner who was standing trial on two counts of offences at the Special Criminal Court in Banjul. He further said that the accused cannot stand trial in two different courts with the same offence.
The police prosecutor handling the case, Inspector Fadera said the accused person’s case file was sent to the Attorney General’s Chambers for legal advice and the prosecution did not know whether the case was transfered or not. He added that the prosecution cannot strike out the case.
Inspector Fadera urged the court to give him time to find out from the Attorney General’s Chambers. It could be recalled that the accused, Andrea Vanroy is standing trial on two counts of criminal offences ranging from rape to sexual abuse of a child, all contrary to the Laws of The Gambia.
The case was adjourned to 4th May 2011.
