One Alpha Omar Barry has been sentenced for stealing from a vehicle contrary to section 256 of the Criminal Procedure Code (CPC) sub section C by the Basse Magistrate court presided over by Magistrate Kijera.
Barry was fined D20,000 or to serve two years in prison. The accused however could not pay the fine.
The presiding magistrate told the court that the said sentence shall be suspended and that the accused shall be bound over to keep the peace and be of good behavior for the period of 5years and in default he shall serve the said sentence before been tried for any subsequent crime he shall have committed.
BARRY’S SECOND CRIME AND CHARGES
Barry was charged by the same court for criminal trespass and assault causing bodily harm, contrary to Section 228.
The charge sheet reads;
Alpha Omar Barry for what you did on Wednesday 20th April 2011 at around 4.10am at Basse Santosu, you were found in the compound of one Younusa Sowe with intent to commit an offence.
The second charge reads ‘Alpha Omar for that you did on Wednesday 2011 at around 4.10am at Basse Santosu, you assaulted one Momodou Saidy Jah with a broken bottle on his head causing bodily harm thereby committing an offence.’
PRESECUTOR INSPECTOR SANYANG.
Police Inspector Sanyang, the prosecutor, brought to the attention of the court that before proceeding with the present case the accuse was on a suspended sentence of a fine of D20,000 or in default to serve 2 years in prison with hard labour in a judgment made on the 14th March 2011. The persecutor said in light of this and considering that the accused has breached the terms of the suspended sentence, he would urge the court to impose the said sentence before the present case before it proceeds.
MAGISTRATE KIJERA’S RULING
The Magistrate ruled that having listened to the prosecution concerning the previous suspended sentence on the charge of stealing he would therefore release the said sentence from suspension and accordingly order that the accused be sent to prison to serve the term of 2 years.
The magistrate adjourned Barry’s new case to Thursday 12 noon for mention.
