Amina Mohammed, the young lady at the centre of the controversial highway robbery and rape case, last Friday failed to appear in court without any notice to the court.

The case was scheduled for cross examination of Mr. Michael Ofosu Frimpong, also known as ‘Amina Brother’, the young man who claimed was also on the Yutong Bus at the time of the alleged mass rape of the passengers by armed robbers.

When the case was called at about 12:15 pm on Friday, Amina was no where to be found at the court premises, however, her counsel, Mr. Andy Appiah-Kubi, told the court that, the accused was on her way coming and asked the court to proceed, since her absences could not alter anything in the case.

But Mr. Paul Asibi Abariga, a state Attorney, objected to the position of the defense counsel, saying it is against the rules of the criminal law procedure to cross examine a witness in the absence of the accused person on trial, adding that, counsel for the accused should take instruction from the court, rather than from the accused person.
He argued that, the court could only proceed to hear the case in the absence of the accused if she had had pleaded guilty in her plea in court.

After listening to both counsel arguments, the presiding Judge, Mrs. Patience Mills-Tetteh adjourned the case till April 15, 2011 for the defense counsel to produce Amina Mohammed before court.
