Sterling is seeking in excess of $1 billion from the league after he was banned for life and fined $2.5 million for a racist tirade that was recorded by his girlfriend.

The disgraced 80-year-old has vowed to fight NBA Commissioner Adam Silver’s sanctions, which has left him on the verge of relinquishing his ownership of the Los Angeles franchise after his wife Shelly Sterling agreed a sale this week.

Lawyer Max Blecher told ESPN : “The (termination) charges in the lawsuit are an invasion of his constitutional rights, violation of anti-trust laws, breach of fiduciary duty and breach of contract.”

The news comes a day after his wife Shelly Sterling agreed to sell the Clippers to former Microsoft CEO Steve Ballmer for $2b following results by medical experts that found her husband to be mentally incapacitated.

And while Sterling’s initial lawsuit is not related to the impending sale, Blecher said his client would look into separate legal action to prevent Ballmer’s possible takeover.

“He’s looking at it. That’s a different kettle of fish. We just got the paperwork on that yesterday. There’s been no decision made on that yet,” he said.

Sterling shocked the world when he told girlfriend V. Stiviano not to bring African-Americans to Clippers games, according to audio obtained by entertainment news outlet TMZ in April.

He took particular exception to a photo posted on Instagram by Stiviano, who was pictured with NBA legend Magic Johnson.

In the 10-minute recording, Sterling said: “In your lousy f**ing Instagrams, you don’t have to have yourself with — walking with black people.”

The audio followed on with more comments from the man, who said: “I’ve known (Magic) well and he should be admired …. I’m just saying that it’s too bad you can’t admire him privately.

“Admire him, bring him here, feed him, f**k him, but don’t put (Magic) on an Instagram for the world to have to see so they have to call me. And don’t bring him to my games.”
