Prophet Nkansah Thrown Out


An Accra Fast Track High Court has dismissed a libel suit filed against Western Publications Limited, publishers of DAILY GUIDE by Prophet Daniel Yaw Nkansah, leader of the defunct New Vision Party (NVP).

The court, presided over by Justice L.L. Mensah, struck out Prophet Nkansah’s writ for failing to ensure compliance with rules of the court under Order 57 Rule 2 and also awarded a cost of GH¢2,000 against him.

When the case was called on May 5, 2014, neither Prophet Nkansah nor his counsel Yaw Anokye Frimpong was in court but DAILY GUIDE was represented by Eric Osei Mensah as counsel.

 
Facts of the case
On February 28, 2014, Prophet Nkansah, through his lawyers, issued a writ of summons to be served on Western Publications for libel after Daily Guide had published a story titled: ‘Prophet Nkansah arrested’ on Thursday October 25, 2012.

He sought damages for libel at GH¢500,000, a perpetual injunction to restrain DAILY GUIDE from further publications, as well as a retraction of the said publication as his reliefs.

In his statement of claim, Prophet Nkansah claimed that DAILY GUIDE had published that he was a self-styled man of God who was at the centre of bribery allegations against two Electoral Commission (EC) officials and was arrested by the police.

According to him, he was neither detained by the police nor put in handcuffs and did not wear the sort of African costume that was captured by the newspaper.

‘In the circumstances therefore, the plaintiff’s hard earned reputation both locally and internationally has been seriously damaged and he has suffered severe distress and embarrassment as many of his followers and admirers have shunned his company both in his New Vision Church and New Vision Party,’ he averred.
