There was a drama at the hearing session of the Ondo State Petition Tribunal sitting in Akure, as governorship candidate of Peoples for Democratic Change (PDC), Mr. Oluwaremi Adetunsin for last year october 20 governorship election withdrew his case against Governor Olusegun Mimiko.
Adetunsin withdrew the case without carrying his counsel, Yinka Orokoto along.
He had earlier notified Tribunal through another counsel that he was no longer interested in the case.
Before his withdrawal, Adetunsi had earlier approached the tribunal to challenge the victory of Governor Olusegun Mimiko in the last October 20, governorship election over the ownership of party logo.
The PDC candidate alleged in his petition that the Indepedent National Electoral Commission (INEC) who is the first respondent, deliberately and wrongfully, omitted his party’s logo which was similar to that of the Labour Party (LP).
He added that this confusion of logo made many voters who ordinarily would have voted for his party to wrongly voted for the Governor Mimiko.
At the hearing of the cases before the tribunal, Adetusin’ s counsel, Orokoto stood up to withdraw his appearance as a counsel through oral application, which was granted unopposed.
Okoto who is also a counsel for Peoples Democratic Party, PDP governorship candidate, Chief Olusola Oke told Journalists that, ” I want to say categorically that my client has the right to withdraw his petition. He gave me a job and he has the right to withdraw that job whether for a reason or no reason at all. Absolutely he thereafter through another counsel filed an application to withdraw the case. Again I say it is absolutely within his right to either continue with the case or discontinued with or without any reason. So everything that has happened is absolutely within his power to do so”.
In his ruling, the Chairman of the three-member panel, Justice A. Kaka’n struck out the case on the ground that the petitioner has earlier sent an application to withdraw the case.
Justice Kaka’n said “having read through the application of withdrawal of PDC and the absent of PDC candidate in the court, I hereby struck out the case”.
In another development, the tribunal has ruled to consolidate all petitions filed before it.
The consolidation came after counsels held a short meeting and decided that the petitions should be consolidated.
Speaking on behalf of the counsels, Chief Wole Olanipekun said his learned colleagues had agreed that the petitions be consolidated.
Justice A. Kaka’n has however ruled that the tribunal be adjourned till 22nd of January.
